The post *213 was when I first receivrd notification from Link that has now moved on to the stage were i am now, which is Bailiffs have obtained Warrant Of Execution, hence the post of Bailiff letter Received, I was advised by Wendy to post seperate threads, is this now wrong?

Thanks Amy, it is complicated as one creditor is applying for repossession and another creditor has a Warrant of Execution, it confuses me and the guy at CAB today,the advise from CAB was to fill in the N224 but I can not make any sense of the form,

Re possession proseedings,I have now completed an income & expenditure form,with the help of CAB, the outcome is I have offered an increase of £20.00 pcm to clear the arrears,although I still dispute the arrears the CAB advised to offer the above and then fight on. I have also sent all the documents I have written and all that I have received to the company who are attempting to secure the miss-selling of PPI by FirstPlus, I will let you know how I progress.

Latest on my efforts to try and save my home, despite continually attempting trying to get advice from CAB,Shelter & The Free legal Advice Line, I am still no further forward,I will be going to court on Monday trying to save my home for repossession,it does seem that the actions of FirstPlus is "like a hammer to crack a nut" all for the sake of a disputed arrears of £838, I have no idea of what the process is or will be,trying to get help is very frustrating,Shelter have so far never answered a call made to them! so if any one can offer help or advice either on here or by e-mail (silverdel@hotmail.co.uk) I'd be grateful.

Hi SD. i can't offer any specific advice, just to say good luck in court on Monday. Have you already completed the defence, paperwork etc for the judge? Is all your paperwork in order ready to speak to it in court?

Hi Wendy, Thanks for the Support!! Me thinks I'll need it!, I've completed the defence paperwork, and am thinking of a defence along the lines of me having already an ongoing claim against FirstPlusfor the miss-selling of PPI, but the thought of court on my own is quite frightening.

Hi ,Update : We attended the court and because I contested the arrears that had been stated to the court in the original documents, I said it was £418 they had stated £838, which was wrong the Judge agreed that court protocol had not been followed.The case was deemed invalid and dismissed,i have now negoiated the arrears be paid off at £20 pcm, so quite a result.
Today( Saturday) some good news,because of the help I have had from members of this site,Curlyben,WendyB Enaid etc!! I have received a letter from Lowells advising that they will no longer be pursuing the debt of £4534(mbna Marks & Spencer) as M&S can not locate any paperwork in connection with the alleged debt, which it means it is unenforceable!!

It must be Christmas??? Opened my post and a letter from Carters informs me that they are suspending any further action on my account whilst themselves and their clients action my DSAR, not bad, only taken a year!!! well not quite true, its a year on the 12th of September,LOL.
