Post #4 on this thread covers the Prove It: Consumer Credit Agreements - A Guide - Legal Beagles

With regards Hillsden and Cabot, we can slap them later on as they have totally failed in their duties, but while they are simply updating you then there's not really much to say.

Tell you what, once the FSA have finished with Link we'll RoShamBo Hillsden and Cabot

I can't help with your Biffa case, what a mare, but I'm sure others can, so get a thread posted

Cheers Ben, i posted a letter on the forum some time ago they helped me prepare the documents for court proceedings, they thought Biffa would have paid out( only £450.00) but it seems that they want their day in court, and I will have to deal with that on my own, the prospect does not worry me, earlier in my life was a Policeman so courts are not a problem!!

Update on the Motor Claim, the solicitors for Biffa have sent a cheque for my excess and costs,
        BUT!!!!
Had a letter from County Court states that LINK have a "Hearing of Application" this is in repect of a debt they purchased from Volvo Finance, do I need to attend?, what action should i take?, should i write to the court? if so what should I say?

Link took over my finance deal with volvo, volvo accepted a £3000 settlement figure, but before i got the money from my motherthey sold the debt to LINK who imediately wanted the full figure of £7300 I refused to pay them and as you are aware by this time was in the process have fighting my Building Society for reposession so I sold the car and settled arrears on the mortgage, now LINK want the £7300 in settlement for the car, this account I have never issued any documents or letters to.

Did you pay Volvo the 3k and have document proof of this F&F ?
SO what are Link applying for ?

No did not payvolvo, they had sold the debt and refused the payment, LINK said they owned the car as i would not pay them the £7500, I think that they were granted the ownership of the car via some court order, anyway i asked them if i could sell the car they gave permission I sold the car,

From what they said some 12 months ago they should have received the money from the garage that bought the car as it was part of a finance deal

Well surely if Link have given you permission to sell and that they should of received payment from the finance why are they still requesting the full 7.5k ??

They never received the money it went into my account and as i said I used it to beat off reposession of my home

they of course now want the £7300 even though I had my offer of £3000 accepted by Volvo and no doubt Link obviously paid far less than £7300 , as i stated in the original question, do i need to attend, do they have to prove the debt and what should be my next course of action, I do beleive that this action is a direct result of my action through the FSA against LINK

What is the purpose of the hearing, I dot understand, is this hearing merely transfering the debt from the material car into another way of allocating the debt, ie a monetary debt?
