    morning, Today had a letter from solicitors who act on behalf of Westcott,s it appears that IQOR have passed the debt( Halifax CC ) to them, solicitors are demanding £3042 in 7 days or court action will follow, What cousre of action do I take?

      So CCA is in play and IQOR are yet to comply, so throw this at them:

      Dear Sir/Madam,

      Your Ref : xxxxx

      Your Client : XXXX

      I refer to your letter of xx/xx/2007, which was received today.

      Frankly, I am surprised of the need to remind a firm of solicitors about the terms and conditions surrounding my Consumer Credit Agreement request (Consumer Credit Act, 1974); received by XX DCA XX on xx/xx. I can only assume therefore that they failed to inform you.

      Should your client now persist with threats of legal action as stated in your letter, I will welcome the opportunity for a judge to look at several offences committed by XXX DCA XX under The Consumer Credit Act, 1974, as well as your client’s non-compliance with and total disregard for the law on this occasion.

          Two telephone calls from Westcot today, when I answer they hang up, they really are pains in the bum!
          Sent letter to Link informing them "Account in Dispute" they also sent to me a form to fill in giving details of earnings etc, surely if the account is still waiting the credit agreement from MBNA this can not be a legal requirment to complete.

            Once the exceed 12 working days + a month, then we'll send some more letters out telling them to go away

                  Hi Guys, todays post was quite fruitfull, Red Castle have caved in and now passes GUS debt back to PHOENIX RECOVERY, Question, Do I now have to send them a letter asking for the missing credit agreement and another £1 or am i covered by the letter sent to red castle.
                  Also had Link on the phone , ansered in standard way, was then told" you think you are being clever but i think you are just trying not tp pay up", this is despite sendind letters of Account in Dispute and link failing to come up with the original credit agreement. By the way I added this account to the SAR that was sent to MBNA even though Link purchased the debt.
                  Also Despite letters and telling the via the telephone Wescot are still ringing me and then putting the telephone down, it is definitely Wescot as have checked the number.

                    Red Castle/Pheonix - Wait and see what they have to say. As and when then approach we'll give them some good news. No need to do another CCA as ONE per account is all that's needed.

                    Link - Well TOUGH on them really, I bet it felt good as well

                    Wescot - Don't know what to say about them, but have you approached BT about changing your number or possible choose to refuse/anon number service ?

                    So all in all, good work there chap

                      WOW!!!!, Thanks CB!! You are right, great to know that I am peeing them off!!., I've made a complaint to OFCOM and contacted Trading Standards too regarding Wescot.

                      Regarding Tesco, I have already sent CCA to them and also sent CCA to the other two also, is it better to wait to see if they can prove the agreement then SAR them or just go ahead with the SAR'S

                        had another telephone call today from Wescot's and as before there was no one on the other end, I rang back told them i had reported them( if any one else is getting this please register your complaint via OFCOM ) they have now told me that the account is on hold and said SORRY and will remove my details at once!!, small result I know, but it feels like a major victory against WESCOT'S!!!

                            what do you reckon Curls?

                            Do we want to prove the debt unenforceable, or get the statements etc anyway in case the charges outweigh the debt?

                              Wait for CCA compliance and then we'll decide which route to take from there.
                              While they are in default of this request there's nowt they can do anyway

                                Thankyou Wendy and CB for all your help I do feel that at last I am getting some where and that the DCA's are starting to take note.
                                Wendy just to put the picture HBOS have tried to use the data prevention act to stop me getting the info as the debt from our joint account is now being pursued by CABOT in my wifes name, sent a letter back and told them not to act in such achildish manner as its obvious a joint account means we are both liable for the debt!
