      Today telephoned Carters and explained the severe hardship, ie not receiving enough to pay the interest on my mortgage never mind other bills eating etc, they informed me that unless i maintain the agreed payments then they will enforce sale of my home, hearless does not describe a company that does not listen to peoples circumstances, HELP!!!!!!!

          My wife received a telephone call this morning at 0805 from a DCA claiming that she is in arrears to GUS catalogue, since we do not have any GUS accounts nor have we since 2002 and they say the debt relates to 2006, they will not deal with me as I am not the account holder want to deal with my wife who has Mental Health Issues, I act for her in all dealings with the DWP etc, but that cuts no ice, any ideas please??

            Yes. DO NOT TALK TO THEM ON THE PHONE. Next time (if) they or anyone else phone, your wife should tell them that she/you/whoever is not prepared to discuss anything over the phone and they should put all communications in writing. It could be that its not even your debt, just someone with the same name and the DCA is just chancing their luck. If you have to speak to them at all, the only thing you should confirm is thier name and address and the name of the person to put in a complaint to.

            See how it goes then we can always send a WendyB or Curlyben special to shut them up and get them off your back.

              Thanks Wendy B, I do find this company's inability to even talk to me about this matter is just absolutely stupid, my wife is not able to cope at all with any type of stress, I seem to hit brick walls.

                Data Protection and all that, they are right not to talk to you I suppose. You will just have to put it in writing, and add in a paragraph giving your wife's permission to talk to you.

                    Simple Answer then.. Hang up on them from now on.
                    A genuine caller will identify themselves with no hesistation

                    If they ask to speak to your wife, just state that due to health issues she requires all correspondance in writing only.

                    If they press you to speak to her, repeat it and hang up on them.

                    You can also start logging dates and times of calls as well

                          Today sees another developement in my on going problems, EOS who were attempting to collect on behalf of Halifax Current Account have now passed this to Cabot, but with a twist in as much as they have now decided to pursue the debt through my wife.
                          The letter is a threat of warrants,charging order DCA, etc
                          Whats my next step in this new action?

                            Interesting.
                            Is this a joint or sole account ?
                            Cabot can be a pain in the rear and threaten all sorts, but not to worry to much.

                            As this is an Overdraft rather than a card/loan, I think the best course of action is go for the inevitable charges.

                            With that in mind a simple Account In Dispute letter to the DCA should make them back off giving you time to SAR the bank and start the reclaim process.

                                Hi Wendy It was a joint account and I do seem to recal that the o/d was fixed at £2k so the remainder of £3840 is charges, what letter do i need to send to Cabot now?
