            Because I cancelled the DD they kindly decided that they would add interest to the debt. But it's ok coz if I start a re payment plan with them they will take it off again. Aren't they just wonderfully generous!!!

                I don't know, but i think I would be to be highly medicated to get to their state of delusion!

                Actually i have flu at the moment and feel horrrible, but have to be at work coz everyine else has either left or is long term sick, so i wouldn't mind a few hours in their world!!!

                  Thanks to the wonderfully talented and ingenious CurlyBen I have sent Thames Credit a lovely letter requesting the return of all the payments I have made, plus interest. A total claim of £858.49. They have until the 26th Jan to respond.

                  Any bets on whether i get a reply???

                        Finally got a response yesterday!! They have now actually sent what they think constitutes a CCA, however I don't think it meets much of the criteria. They have also said some waffle about not having to send a copy of deed of assignment. They state that a letter they sent on the 21/04/04 of BC's notification covers it, but they never sent that letter with the SAR stuff!! Also there is no mention of it what so ever on the notes that they sent - the notes don't start until 05/05/04!!

                        What's my next step? Do I continue with the court action, or should i try to get them to admit that this debt is unenforceable first? Should I be complaining to the FSA/OFT etc???

                              Well what they have sent is COMPLETELY unacceptable and totally non-compliant.
                              I see no prescribed terms at all !!!
                              Nice of them to confirm that they don't have an executed agreement at all

                              Let me think on this and I'll post you a letter for them.

                              I love the last part of the last letter as they refer to adding interest in accordance with the B'card T&C, which they haven't even bothered to include !!!

                              No matter they are on a hiding to nothing here and I think they know it.

                              Next letter will be an LBA then filing in court.

                                They aren't going to roll over on this one are they!! so court action is going to be necessary. What can i do to prepare for this - I am reading through the CCA stuff and why it is isn't compliant (they are so many reasons why what they sent isn't compliant it's hard to know where to start!!)

                                Should i be reporting them to Trading Standards/FSA/OFT etc as they are clearing breaching rules by requesting payment - not to mention the addition of nearly £3,00 worth of interest!! Especially 2 lots a month!!!

                                They have more bottle than unigate!!!
