    I had a run in with CAPQUEST a few years ago, supposedly thay told me that they were sold the debt from Halifax.

    When I sent then a CCA they supplied only copy bank statements, their statements went back to 18 years more years than I had already had, which pleased me as their were loads of charges ( hence my current claim). But they could not to my satisfaction supply me with the proof of the deed of assignment to prove that they were entitled to claim the debt. They kept on writing and phoning and were complete pests. After many letters from them, they send 2 or 3 letters at a time all coming in separate envelopes and phonecalls......But I was very firm and told them that they had not fulfilled the CCA request etc....

    They eventually gave up the ghost and handed the debt back to the halifax and sent me a letter confirming. It is apparent that did not actually own the debt or otherwise they would have been very eager to fight me all the way to get their money. It became very clear that if they had had the proof which I required they would have supplied it as soon as I asked for it.

    Whatever you do, do not let them intimidate you and stand your ground. The CCA is the way forward.

      I had to search for this thread as its been that long since Capquest have contacted us!! But out of the blue we get a statement from them yesterday (How come there's a postal strike but the bills still get through!!!)

      Anyhow We geta statement - nothing else, no demand for repayment, just a one sided statement, which kindly lists all the interest they are applying to the account on a month basis.

      I have never had a response to the CCA or any proof that we owe this debt.

      Do I just stick in the draw and ignore????

        Yep
        just pop it in the drawer and ignore.
        If you reply to any letter you are basically acknowleding receipt of it.
        Until they provide the CCA dont communicate :tinysmile_hmm_t2:
