      Just spotted this one.

      When I beat this lot recently (still not paid me though) I filed N1 as Capital One Services, as that was the name on a letter, or the address details for claims.

      When the Service was Acknowledged, the court informed me that the name was incorrect and had been changed as it should be Capital One Bank. I have the documents to prove this if you want to have fun making the point

      I know who I'd believe.

            2 letters received today, 1 each, sod off you're not having your charges back, you should be eternally grateful we gave you a card in the first place etc, etc.

            Must check my dates, N1 must be due about now.

                OK I know its a bit late but N1 form has finally gone in the post.

                I have included an extra paragraph in the POC's regarding the OFT Credit Card report so lets hope that makes a difference and they won't just order a stay until the test case.

                CI does whack it up rather but I'm taking comfort from those who have gone before and reassured me they will pay out before court, if they don't I'm gonna go camping with Bill in Glenns garden for a week before the case!!!

                  I know they normally cough up before court, but whats the timescale re court, filing, stays etc? I'm not sure about how it works? As in, do they cough up as soon as they know you've filed, or if there's gonna be a stay would they know this straight off, or what? Can't get my head round this....but then I have got two directors in the office today doing my head in and giving me grief, why don't they just bugger off and let me get on with stuff

                    From what I've read, cases aren't being stayed until after the AQ has gone in, now call me a cynic if you wish, but that's another £100 in the court coffers.

                    I also think Cap One pay up at/around defence time so that would be OK.

                    I believe MCOL are staying all new cases, but not clear if this is just banks or includes CC's too but I don't do MCOL so that won't effect me.

                    Open a Word document and autohide your task bar then practice pressing alt+tab to switch into word when anyone comes near - works for me!!!!

                      I've got so many programs open on my computer that its only a quick flick to be in something else- past master at it, but it means I can't concentrate properly on the important stuff like bank charges and so on

                      I think I might do the court route then, i was just worried that what was the point of paying 60 quid to the courts then getting stayed for ages, might as well take cap One's measly offer now.
                      So basically if i file it will frighten em into paying up before anything gets done about staying the case? Well thats alright then, another week and I'm off to court with an N1. Of course, my last letter might have scared em into paying in full now (but I won't hold my breath)

                          Claim issued 23rd August, Deemed Served 25th August, they have until 10th September to respond.
