    Prelim for charges + CI on my accounts gone today, recorded delivery of course, OH's going tomorrow.

        Went to the post office to post the OH's Prelim today by recorded delivery, I had 1p in my purse!! had to pay with two large first class stamps and a 10p I found at the bottom of my bag :o

          Replies received to both prelims:

          Mine says basically their previous offer is still open but they won't improve on it, i particularly like this bit:

          We only add these fees when a customer breaches their contract in this way
          They're not going for the service fee defence then?

          OH's says they paid £126 including £10 interest into his account

          OFT haven't challenged the right of banks to charge default fees, but merely the level of these fees
          Hope I have explained things clearly

            One interesting point that came out at my last rant at Cap One, the manager that I spoke to told me that Cap One IS NOT a bank

                  I don't know cos I challenged her on that bit, apparently they are allowed to call themselves that cos they deal with credit cards, but she did catagorically say that it wasn't a bank as it didn't have it's own clearing system.

                      LBA going either Wednesday or Thursday, and they are now on day 13 for the CCA request.

                      Tell ya what is funny, had a phone call from them before the letter got to them, and they were chasing the fact that I was about £3 over my limit (due to charges of course). I got the woman to confirm that they had my CCA request, and that by having that the account was in dispute.... so I asked her why she was chasing me if the account in dispute, and her response was 'we will continue to phone until you bring your account back into order, dispute or not'

                      So I kindly told her that she has no right to chase a disputed debt and that I was going to speak to the FOS and OFT about their ability to adhere to the law and their suitability to hold a credit licence, I think it may have been that bit that made them refund me £12 for the latest charge on the account.

                      Oh well, it's very nearly at 3k now, by the time they get their act together it will have hit the 3k mark, heeeee heeee

                          Just done it and discovered i made a bit of a typo on my prelim and added £300 too much interest, i was tempted to leave it but i have corrected it so my claim has gone down a little, it will be in the post tomorrow.

                              Jan am sorry to hijack your thread hun but would ya help explain to me how i work out interest going back 6 yrs thanks please just pm me or email.......Crap1 owe me approx £400 without interest but am not sure if i am working it out properly and was told you a genius at it hun
