MBNA account 2 - F&F

    Hi everyone!

    Just looking for some further advice on this if I may please -

    Today the DCA that now owns OH's account wrote the following in response to my queries regarding the F&F -

    'In response to your letter we would like to confirm that once we receive the full and final offer payment of XXXX we will update your credit file and your account will remain closed.

    We can confirm that the account number prior to XXXXXXXXXX purchasing your account was XXXXXXXXXXXXXX and all liability for the above account will be removed once the payment has been received.'

    I have said that payment (by third party cheque) can be made within ten days of their agreeing in writing to my terms.

    I had asked (as per my previous posts) for confirmation that neither they, nor any associate company or third party would pursue OH for the remainder or sell the balance on etc (wording as per National Debtline guidance) but they have not stated that this will be the case.

    Do I need to write again specifically asking for confirmation of this or is what they have said sufficient?

      I don't know, but if it was me I would play safe. As you're so close to agreeing a settlement I can't see why the normal rule of not talking over the phone cannot be broken. BUT I personally would not pay them a penny until you get exactly what you want in writing. Call me cynical, but I would never trust a DCA as far as I could throw them! Protect yourself - if they are genuine they will understand your concerns and will give what you ask for.

      I did read recently of someone writing on the back of the actual cheque and photocopying it before they sent it off - do not cash this cheque unless you agree it is in full and final settlement of.... blah blah blah.... don't know if this would hold water in a court though!

          Absolutely right Ame! Very clear indeed. OP IMHO you're safe to pay it then - another debt bites the dust.

          And well done you for negotiating such a good settlement - bet you wish you'd offered 5% now lol

            Just a quickie to say that the third party F&F cheque for this account has today been sent, so that's one down and three more to go

              Well done Nellie, hope you manage to get them others sorted and soon.
              That is one hell of an amount you have reclaimed makes you wonder just how many unknowing poor soles have paid that and don't have a clue they have been ripped off.

                Yes, it will be good to get shot of them all! When we sold our last house we managed to clear three other accounts in full - it was pre LB and I had no idea about negotiating reduced F&Fs or that I could reclaim the PPI which had been mis-sold (I was a stay at home mum, so not employed and therefore the PPI was no use to me and OH was told by LTSB etc that he had to have it or wouldn't be approved for their loans). Unfortunately due to OH's problems with depression etc we have had to utilise a good deal of the monies reclaimed to keep our heads above water over the last 18 months but now with the large PPI payout from Norton we are finally in a position to clear the remainder.............hopefully!

                As you rightly say, there must be sooooooooo many people out there who are still paying for PPI which is quite possibly of little or no use to them and yet have no idea it is even there, let alone reclaimable. Thank goodness for sites like LB - that's all I can say!
