    You will think me a real Dweeb but yes I have all the statements from 24/02/05. The interest rate was zero as I was paying all at the end of the month. Cash withdrawal 2.207% in May and June 06 and from the 10th Aug rising to 3%.
    Oct 07 - purchase interest 2.207 - 20/10/07 cash - same
    Dec07 - ditto 2.528
    March 08 ditto Annual rate quoted 30.340%
    Dec 09 gone up to 34.080%

    Edit - When the CC people send the copy of the CCA plus terms, the could lack of a page be interpreted as being outside the legal framework of the legislation?

              Cougar is saying to pay off all within three payments which totals £3500. One of £400 on the 5th Oct followed by two instalments of £1200 which adds up to £2800 in as they would accept a discount of £700 if paid in three instalments.

              Now, I am still not happy with the legality of their demand as I consider that we are still in dispute. (I'll eventually pay it off anyway but in my own time).

              Whilst Kerobo has gone, they did send me a case note which "identified" breaches. I would still like to fight this case and tell the DCA to stick their idea of settlement.

              Any ideas?

                    Have a read of the thread that that is on too, will give you some guidance.

                    I'll have to get the maths geeks lol to check the interest rate calcs that Kerobo came up with on their list of breaches.

                      Okay Credit Card agreement - no need for a total charge for credit figure - no idea where Kerobo have got the figure of £515.56 from. TCC on the APR for purchases would be about £223 (based on £1500)

                      You sure that is for this card ? You didnt have a loan with them as well ?

                      anyhoo have you got the page of terms which has term para 23 on - and is that the 'Use of Information' paragraph ? (if you look on front of agreement you'll see it refers to it)

                      The interest rates are different to those in your terms but as this is an earlier agreement thats no suprise lol. I just put it here for example for you to show that the backs DO have the prescribed terms on.

                      If you look you'll see it says terms taken from main terms paras 8,10 and 23 (ie the para 23 I mentioned above)

                      Still dunno where they got the £515 TCC from tho.

                        Sadly, they were a Claims Management Company - authorised by the MOJ and ran a series of adverts on the radio which must have cost them a fortune.

                          I didn't know they were actually out of business, how did that come about?

                          You can bet they took a lot of peoples' money with them. I mentioned before that I worked briefly for a company which took their (very ANGRY) calls.

                          I wonder if they got paid...

                              Unfortunately I spoke to Cougar re settlement but did not mention paying the Nov Dec payment only that IF things went well then I would arrange to pay off the rest in maybe two instalments. I suppose my call has nullified my defence. Aaargh
