  • TonyB - v - Crap One ***SETTLED***

As it seems to have gone a bit quiet, I thought I'd post up Bloke's Crap One claim. After a few mins on the phone the other nght, they've told him he had 2 accounts, one Visa, one Mastercard. News to us, but if it means more dosh then lets go for it. Nice helpful Crap One peep is going to send statements for free, said up to 21 days. So lets see what happens.......

Well, cause they were so quick I felt obliged to match themmsl: - prelim is ready to go, just gotta get OH to sign it tonight and it will be off tomorrow. Have gone for interest at 14.%, which is the same rate I used on my claim. Have called it "interest", not CI or CCI cos I think thats getting a bit confusing now. What does everyone think? Should it be DI and do you think that rate would be okay?

IMO dont know what DI is?
I just charged whatever they charged me

think mine was about 14 ish %, so go for it, this is on top of the statutory interest, yes?

Got the term from OTR. I'm just gonna call it interest - less confusing!!!! Haven't added ths stat interest yet, will wait till filing at Court, which no doubt we'll have to. Am only going for interest at all because I've already won once against them, on his Natwest card am just going for the straight charges.

Prelim finally posted yesterday, I reckon we should get a crappy offer of about £120 plus a few quid interest by about next Wednesday. Am preparing my bugger off gimme all the money or else LBA in advance. Think I'll do the N1 while I'm at it. Nothing like being prepared

I think it is, basically its the interest charged on the charges, compounded from the date of each charge. I used the rate they were charging me, which was 14.0%.

                    Re: TonyB - v - Crap One

As i expected, received letter offering £128 plus £10 interest, as they're reducing all the 20 quid to 12. How sweet of them! They seem to have added on an extra charge somewhere as well cos thier figures aren't the same as mine. Have got LBA/Partial acceptance all ready to post once the strike is over. Am nearly ready with a pre-prepared N1 which I'll take to court as soon as i get their final final final bog off letter - I reckon about a week on Monday allowing for the strike. Why don't they just pay up and save themselves the money in the first place??
oh well, it's just more money for my Crimbo fund.

Just doing N1 ready for 22nd or thereabouts. In the light of it being interest not CI, have had a modge round with the POC, can someone have a look please and let me know it if it makes sense or not

                        Thanks

Is the interest (8%) not supposed to be 0.22p per day wendy?

                            Re: TonyB - v - Crap One

I got it from the template POC on this site

"Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx (charges x 0.00022 = pence per day figure) per day OR at such rate and for such periods as the court deems just."

                            charges £300 x 0.00022 = 0.066 per day.

Is this right? I'm sure its what I put on my own Crap One POC and they paid up. To be truthful I'm not sure Crap One even read POC's anyway lol but I don't want to cock it up.

Yes it is correct, couldn't work it out yesterday as there was no amount of charges on the POC.
