    Many thanks to everybody here. I received a new year present from MBNA over my credit card charges. A cheque of £450 was sent to me as a settlement for my unlawful charges claim.

    The letter reads:
    As we explained in our previous letter on this matter, we have always set out precisely what our charfes are in our agreements wuth you. They are integral part of the terms and conditions under which we are prepared to provide credit facilities and our view is that the charges that you agreed to are valid, fair and enforceable.

    However, it appears that you disgree with our position and are dissatisfied with the offer that has been made to you. In an effort to maintain our relationship with you, we would like to resolve this matter to your satisfaction.
    We have therefore arranged a further goodwill payment of £450.00 to be sent to you by cheque, (please find enclosed)

    You will appreciate that this does not mean that we accept or agree with your complaint, but I trust that you will find this an acceptable resolution.

    This is our final response to your complaint. If you remain dissatisfied with the response, you may refer your complaint to the Financial Ombudsman Service, within six months of the date of this final response. Their address is as follows:

    Before I go. Does anyone knows the next step as I still have outsatnding debt with them. Do I have to contact MBNA to arrange the payment of this debt?

      How much is the outstanding Debt ? Has the card being defaulted ?

      Do you have an income and expenditure sheet prepared ?

        Odd that they have sent you a cheque if you still have an outstanding balance with them. they would normally use the refund to reduce the balance.

          According to the recently received statement (before the arrival of the cheque), they say I am still owing them £1500+ late payment fee of £12

          How much is the outstanding Debt ? Has the card being defaulted ?

          Do you have an income and expenditure sheet prepared ?

          I believe the card had been defaulted. And I have never filled any expenditure sheet.


          Odd that they have sent you a cheque if you still have an outstanding balance with them. they would normally use the refund to reduce the balance.

                No I am not saying I think your debt has been written off. I am saying that I find it odd that they sent you a cheque instead of using the refund to reduce the balance owing, whivh is what they usually do.

                    I think that if MBNA have already defaulted a debt they cannot automatically refund the charges back to the account without your agreement??

                      Why not? If it's defaulted, you still owe it to them. Capital One had defaulted me but they still took what I owed them off and then sent me the balance. And the default will still show on the credit record till its totally satisfied too.
