    Re: Ammani V Cap1

    Good Evening Budgie,

thank you so much, for spending your time, with this, i am so very greatful to you.

Lets see if anyone calls me tomorrow, from Capital One. It would be nice to get this resolved, i could do with the money at the moment, as work is very slow, and i have taken a cut in my wages.

I was wondering, as the court didnt serve Capital One with the claim forms, 18 months ago, when i put them in the court, does that mean i would have to start from scratch, and re submit new claim forms, or would they send the old ones? I dont see why i should pay to amend my particulars of claim, when they didnt bother to send the claim form to Capital One, in the first place!

    Kindest Regards

    Ellita.

        Re: Ammani V Cap1

        HELP!

Anyone any suggestions how i proceed! The court is of no help at all. Do i need to make a new claim?

My last claim was not submitted to Capital One, even though i sent it to the court, 18 months ago, so i dont know what i should do now. How can i ask for a stay on a case that was never served?

I was told, by court clerk, when asked why it wasnt submitted, that i would have to write to the judge if i wanted anything!

        Whats that supposed to mean?

This has dragged on for some time now, and is starting to stress me out. I have emailed Capital One several times, but still no answer, and i have not had any calls from any one at Capital One.

Any advice will be greatly appreciated.

Strange they wouldnt tell you why it wasnt served. They should at least have written to you to tell you.

It could be the court decided not to serve anything to do with charges.

I would write an informal letter to the court for the attention of the judge referencing your claim number giving a time line and asking why your claim hasn't been served.
