  • MBNA. Have they moved the goal posts?

    I have followed the sites advice and templates but recieved the following from MBNA and would like some help please.

    "We refer to your recent corrrespondence concerning default fees on your account. I would like to clarify the situation from our perspective.

    We have always set out precisely what our charges are in our agreement with you, as they are an integral part of the terms and conditions under which we are prepared to provide credit facilities. Late payments by customers cause us to incur substantial costs in dealing with their default.
    Similarly, we have set credit limits carefully for each customer for good reason. We expect every customer to respect their credit limit. If a customer goes over their credit limit, he or she is using the card in a way that is not allowes, in effect obtaining unauthorised borrowing. We, therefore, lend more than we agreed to and take on risks which we never accepted in the first place. In the case of both late payments and overlimit usage, and also where a cheque or direct debit is returned unpaid, we look at the portfolio as a whole and set uniform charges reflecting our costs of dealing with such defaults overall, as do all other major credit card providers. This approach allows us to be clear and upfront about all default charges and the basis on which they are applied.

    You may know that the office of Fair Trading issued guidelines in April 2006 in relation to the level of credit card default charges across the industry. MBNA disagrees with the OFT's interpretation of the law and continues to maintain that its default charges have always been FAIR, LEGAL AND TRANSPARENT. However, we decided to reduce our default charges to £12 with effect from 28 June 2006 for late payments aand returned payments, and 28 July 2006 for overlimit fees. You will have recieved notificatioin of the changes to the terms and conditions, which we expect you to honour. Term 3a explicitly details the amount and circumstance of each charge.

    Nevertheless, we wish to resolve your complaint to your satisfaction. We would therfore like to offer you a goodwill payment of £xxx, which will effectively reduce all of the fees you have paid, to the reduced fee of £12. WE MUST REITERATE THAT WE DO NOT ACCEPT THE OFT's POSITION, and that this payment is offered solely as amatter of goodwill. I have arranged for this payment to be credited to your account. I trust that you will find this an acceptable resolution.

    IN RELATION TO FEES CHARGED SINCE JULY 2006, WE WILL NOT MAKE ANY OFFER TO SETTLE THIS ELEMENT OF YOUR COMPLAINT. AS I HAVE EXPLAINED ABOVE, OUR FEES ARE FAIR, LEGAL AND TRANSPARENT AND ARE CONSISTENT WITH THE OFT's GUIDELINES"

    It then goes on about the usual FOS blurb.
    So is the standard reply you reccomend enough?
    If MBNA disagree with these guidelines why did they reduce charges to the level suggested by the OFT?
    I also insisted on a cheque is it their usual practice to apply refunds to an account?

    Any help much appreciated.

    have you read my MBNA thread here. Don't know how I had such an easy time of it with them, but I did.

    Is this the first offer they've made? Write back with the partial aceptance letter, not sure if it's on here, in the library, but I'm sure it's on one of my threads somewhere. Will try to dig it out for you later. Unless you adapt the one I sent to MBNA. If that fails, file at court.

    They won't send you a cheque unles your account is in credit, they will always use the refund to reduce the balance, which is good really because it means you owe them less. Although saying that, we have now been waiting 3 weeks for the cheque which was supposed to arrive in 10 days.....

      Hi Wendy

      Thank you for your very quick reply. I will adapt the letter you sent and get it off this weekend.

      The reason I asked for a cheque is that although my account is not in credit it is now under control and I could use the money to address other more pressing debts.

      My own computer is down so relying on the library so apologies if my response takes some time.

        You'll find they will credit it to your account anyway, if they haven't they will do shortly. Good luck and hope they come through.

          Sent partial acceptance letter and 14 days to reply ended on Friday so I called customer services. They informed me that they had recieved the letter but that legally they had 6 weeks to reply. I said I would check on this and get back to them?
          Is this the case or should I refer to the FOS then the courts as I detailed in my partial acceptance?

            If you were doing prelim/lba on court action then you stick to your time limits given. (14+14 days probably?)

            They have 8 weeks to resolve initial complaint before you can go to FOS so unless the partial offer was within two weeks of first letter of complaint then stick to that 8 weeks if you are going FOS route.

            Just because they made a partial offer doesnt reset the clock on the 8 weeks.

              I never took it to the FOS or court. I just waited till they'd credited my account with the first offer then sent them a second lette, 3 weeks later they sent the reply giving another 885 quid that I didn't even know thy'd charged in the first place. Give it a couple of weeks and see what happens. Even possibly wait the 6 weeks, it will save you the hassle of writing letters to the FOS etc and then filing at court. Well thtas what I'd do anyway

                Result!

                Cannot thank you all enough for your help.
                Initially put in for £1500 of charges, first offer was £400, sent letter back accepting part payment.
                The second letter after this offered a final figure on top of the £400 of some £2500!!!!
                This has roughly halved the amount I owe and it would not have been possible without this site.

                    Brilliant result!! As to why they are giving you lots more than you claimed, it's probably interest. You can't tell as they never give you a breakdown of how they've calculated the refund, but if I were you I'd let sleeping dogs lie, wait for it to hit your account and halve the balance, then carry on paying the same amount as you were paying before, that way you will pay it off even quicker.

                    Looks like you might be close to the MBNA record payout time (Previously held by Moi, I believe, but I don't mind you taking my title lol)

                      Even more fabulous someone got out the right side of bed this morning !

                      MBNA tend to add contractual interest - well they used to havent seen it for a while - so that'll be where the extra is from I expect.

                        Thank you all for your replies. As you mention it could be several things but I am not going to question it.
                        Will now change my direct debit to standing order as the direct debit will only allow the minimum payment.

                          Well if you ring them up they can set the dd to whatever you want it to be. Ours was set for ages at £50 although the minimum payment was far less than that.

                              I suppose it depends who you get on the other end of the phone. If that's the case, I would leave the dd in place, then at least you know they will take at least the minimum, but also set up a standing order as well for any extra you want to pay, or just pay the extra in over the counter at the bank/post office using your statement.
