    I have accumulated charges of £84.00 for going over my limit due to interest charges applied by Cap one. These are £12.00 charges.

    I have sent the prelim, and they replied back to say that as they had previously refunded my charges back in 2006, they will not be making anymore refunds and I should take it to the FOS.

    What do i do now?

    Send LBA?

    Contact FOS?

    Hi Worried

    I would send the LBA and follow your plan not theirs and if after 14 days they do not pay you then issue a claim against them and then they should pay up.

      Should I wait the full 14 days since I sent my original letter? They have responded to me within a week.

        As they have already responded and you have a reference number, I would write now, no time like the present TBVH, the quicker you write and get the ball rolling the quicker they will pay.

            I am now rready to file my claim against Capital one.

            Am I better off using MCOL or going directly to the court to file?

              Best to do it by taking N1 to court, if you use MCOL there's not enough space for the POC, plus it stands a chance of getting stayed automatically with MCOL.

                  if it won't fit on the N1 form, write see attached and type it onto a separate sheet and staple it together. Don't forget you need 3 copies of the N1 and everything to file at court. One for them, one for the court and one for you.
