WESCOT have produced CCA from Halifax and Lloyd’s

  • WESCOT have produced CCA from Halifax and Lloyd’s

    but they just look like mass generated documents with my name added to 1.

    Can anyone take a look st them for me ? Debt was previously unenforceable due to no CCA’s and now hey presto!

    Re-constitutions of documents are acceptable by the court.

    How long ago did the accounts default? Was the last payment to them (or any debt collector) made before that date? If not when was the last payment?

      I will double check last dates paid. I was paying through StepChange and didn’t even know you could challenge if there was no CCA.

        If you know you have paid in the last 6 years to them then there's no need to check a specific date?

          Lloyd’s default was 12.10.17
          Halifax default was 4.12.17

          Stepchange continued to make payment to April 2019.

            Ok, so if I have paid in last 6 years and they can provide a basic CCA I have no come back?

              Neither are Statute Barred, assuming the recons would stand up in court your final attempt would be for notices of assignment and default notices.

                  Write to them and say you don't recall having a debt with them, that what they have sent you are from Halifax and Lloyds, so you want to see Notices of Assignment from them both that they are now the legal owner of the debt and copies of the default notices.
