My charges are from your compound spreadie, attached.

I've not paid anything for months.

Please would you let me know what you think?

      Re: Birdie v Capital One

      Thanks Birdie

Trouble is with this claim that return of the charges will only make a slight dent in your present card balance and any short term benefit that you see by the return of the charges will be swallowed up by their ridiculously high interest charges.

Have you any other credit cards against which you can start a claim.

To be honest I would be a bit worried about you commencing a claim against Capital One at the moment with the high balance on the account and taking into account that you have said that you havent paid them anything for a while.

Let me think about this for a bit.

Well the "agreement" would make a good paper aeroplane, but as a credit agreement it is unenforceablily floored.
As ever there are ZERO prescribed terms and as it is a pre May 2005 agreement they MUST be within the signature document, seperate T&C's are UNacceptable.

As for the supplied T&C's they are the current ones and have nothing to do with this account, so again another strike.

All in all it's your call, charges OR unenforceability, NOT both !!

So, have heard nothing still from Crap One since their letter of 13th November 2008 when the DCA obviously passed it back to them.

Think I'll just sit on it for now and focus on the other debts (!!) what can they do if they decide to take me court? Nothing I guess, if it is unenforceable? Or am I wrong?

            Many thanks.

Received a sweet letter today from Capital One telling me that that they've sold the debt to CapQuest, - duh, well I already know that don't I, 'cos Capquest wrote to me.

                          Re: Birdie v Capital One

As ever complete cobblers from CQ.
How nice to send an LBA dated 9th concerning action starting on the 13th which only arrived on the 14th.
Hmm ignore pre-action protocols some what me thinks.

Well we know the Cap1 documentation is completely unenforceable, so CQ can whistle.

Just send them an adapted version on the Non-compliant CCA from my CCA thread, actually I might be inclined to send them the formal complaint version

Bit of a faux pas from me - forgot to send a complaint letter, see previous 2 posts.

Have now received this letter, soooo, should I send a complaint letter to the solicitors or the DCA?

                              Many thanks!

Ignore HL as they are simple Solicitors for Hire

I assume you have sent a dispute notice to CQ ?
