  • Default in 2003

    Hello all,
    This is my first post.
i had a goldfish credit card back in 2003 but got into financial difficulties and ended up on a DMP with cccs (step change). The goldfish debt was passed onto Cabot who waited until 2009 to issue a default notice. This debt is now repaid but obviously the default will remain on my credit file until 2015. Should the default not have been registered in 2003 when I was making vastly reduced payments? Thanks in advance for your replies.

Technically yes. Are you sure you are not being defaulted twice for the same debt, as this is not permitted? Even if you are not, and Goldfish didn't default you when they should have, I fear there will be very little you can do about it now, except wait another two years for it to die by itself. :beagle:

Thanks for your reply. Yes I may have been defaulted twice but don't have access to my credit report that far back. Could I contact Cabot and ask them to remove the default?

It's possible that, after this length of time, the paperwoerk on this has gone AWOL.

        You could try this

I'd say it's certainly worth a try. :thumb:

Sadly, what you describe seems to happen to a lot of people who enter into DMPs, they get defaulted years after breaking their contractual terms which is when they should be defaulted. Unfortunately the guidance on recording defaults with the CRAs is just that, guidance.

I am having exactly this argument elsewhere at the moment. You are absolutely right. ALL the really good stuff produced is just guidance; why it can't be enshrined in legislation is beyond me! A cynic would say it wouldn't suit the powers that be for the legislation to be that good.

              Hello all,
After checking through my paperwork today i have found the original default notice.
This was issued by Morgan Stanley whom I assume were taken over by Goldfish cards.
I have sent a complaint to Cabot to look into this.
Do you think its worth sending a SAR?
