  • CCA request reply from Apex credit management

I have had the following reply from apex Credit Management in response to my recent CCA letter along with my returned postal order for £1:

We can confirm that Apex are not the legal owners of your account and are not the data holding branch, therefore are not obliged to supply the data you have requested, this information should be requested from our client.

Please be advised you will need to contact Santander directly to require a copy of your CCA and enclose a mandatory fee of £1. Alternatively if you require a Subject Access Request showing a copy of all data held on our system please request this in writing with a mandatory fee of £10.

Is this correct as I have been paying Apex for years via a DMP?

    Many Thanks

Are Apex acting as an agent for Santander or have they purchased the debt of Santander ( do Apex allege they have been assigned the debt ?)

      nb:
'' If it is your view that you are not the creditor, s.175 of the CCA1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. ''
