Re: barclaycard cca request
Quiet standard fayre when they can't find your agreement. They are currently unable to enforce the debt, if they find it in the future (within six years anyway) they would then be able to enforce it, and they can still chase you and muck up your credit file (arguable)., but they can't get a court judgment against you whilst in default of your request.
Do you want to go through a bit of a history of the debt and your circs and what your aim is with this? peeps might be able to help a bit more.#staysafestayhome

Re: barclaycard cca request
Well, your credit file is probably pooped anyway, so you can carry on with your DMP or knock this one on the head and take your chances that they don't find the agreement until its stat barred in six years. If they come up with the agreement in a few months you should be able to negotiate to restart your DMP payments with them. Your DMP will probably be proportionaly spread across your debts, so won't necessarily mean more in your pocket but might pay some of the others off a bit quicker.
What was the purpose of sending the CCA originaly?#staysafestayhome

Re: barclaycard cca request
Is the DMP still paying this account?
If so the debt does not become statute barred even
though it is removed fro credit files on the 6th anniversary
of the default date.
Any payment in the relevant 6 year period restarts the six year
clock.

Re: barclaycard cca request
They could start a court claim ( could but after nearly 6 years without doing so a court may not look favourably on a claim).
This is a common trap, with DMP's one sees that the entry will be removed from credit files after 6 years but any payment restarts the 6 year clock.

Re: barclaycard cca request
I had 2 egg accounts transferred to Barclaycard. I found myself no longer able to pay them and received letters very similar to yours after my CCA requests.
I no longer pay them and do not expect them to find the agreements so have just filed them away.
They occasionally write to me asking for payment proposals but I do not bother replying

Re: barclaycard cca request
My old Egg cc account was sold to Barclaycard some years ago.
Egg soon sent my 2002 agreement when I asked for it in 2009, but I don't know how efficient they were passing them all on to Barclaycard.
Barclaycard did say the Egg account was transferred to them in 2011, but I heard nothing more until Marlin started chasing me for a Barclaycard debt bearing a completely different account number in 2013.
I simply replied I have never had an account (or agreement) with Barclaycard. Heard nothing since.
I don't expect Barclaycard will find many of the old Egg agreements. They were out to get me!! But now it's too late!!

Re: barclaycard cca request
Barclaycard have tried sending out reconstituted agreements for old Egg
accounts using Barclaycard terms and conditions, the transfer of the accounts
was sloppy to say the least .
Stopping the DMP is a reasonable step imo.
Just to see what PRA has to say,.
PRA " acquired" a portfolio of these old debts and I've seen them
lose out on quite a few due to poor or non existent paperwork.
BC flogged the debts knowing full well that many were unenforceable.
