    But you are charging for costs that you do not incur. If the service is terminated your costs are gone or are you saying the monthly charge is pure profit?

      We're only charging the customer in line with their minimum commitment, which they agreed to at the point of sale.

        Hi Everyone,

        Today got my second letter from Bryan Carter saying that my account is on hold until they hear back from Lowell. I dont know why they had to send another letter? Very Strange..........maybe they want to increase the costs? They have 6 more working days then I guess the account becomes unenforceable as this will be the 12 working days, is this correct?

          Hi Everyone,

          Got a letter from Lowells dated the 1st May 2014 but it arrived on the 6th May 2014 funny that. But the letter states that they have received my letter and cheque for £1.00 but they sent the cheque back saying that as this is for a service agreement and not a credit agreement they Vodafone has no obligation to provide a signed agreement under the provisions of the CCA. Very strange, I would have thought that they have to provide this information.

          They advise me as well that although Lowell is the legal owner of the account probably brought for £1.00!!!!! the general management has been outsourced to Fredrickson International Ltd and as a result all future communications should be sent to them. Alithough it does say that please call them if I require any further information.

          I am confused now as to what I should I do.............

          It sounds to me like they dont know what they are doing so they are passing this onto someone else who doesnt know what to do with it.

          Please advise as to the next course of action, the original letter that was sent on Thursday 24th May to Lowells and Bryan Carter now has been with them for 9 working days so by the end of this week it will be over the 14 working days which does this mean this now becomes unenforceable?

            What’s the email reference for the one you resent? Did you put ‘WRT135 - FAO Lee’ in the subject line (with no additional characters or spaces)?

              Oh gosh Nigel, we've completely missed your post - Thanks to Jen for flagging it up.

              Lowells are correct in that the CCA does not apply to mobile phone contracts.

              Have they actually bought any court action against you ?

                I have sent this a couple of times to Lee but only once did it send me a reply email with a reference number 6758800, but Lee said he didnt receive anything. Perhaps you can double check.

                  That's okay M1 was initially helping me out. They haven't brought any court action just threatening letters. I would like some suggestions, ideas as to how i can prevent going to court and to see what I can do about this.

                      I just wanted to give you an update since I last wrote this thread. Lowell have written to me at the start of this year saying that do I have any more information about the account that they can look into. Well I was doing some clearing out over the Christmas break of 2015 and I found the Vodafone transfer of ownership form so I copied this and sent this to them. They then wrote back to say they were going to look into this and my account is on hold! That's very kind of them! Anyway after months of not hearing from them they wrote to me today saying that I have 30days to reply from the date stated on their letter! Funny how it takes a week from the date on the letter to me receiving it.
                      They say they have carefully considered all the information that you and Vodafone have provided.
                      Vodafone have advised the account was setup in your name not a business name, credit check done on my name not a business.
                      The balance is £820.03 and they have not found any supporting note about this latter.

                      Therefore the balance is owing and valid.

                      I am not disputing the fact that the account was set up in my name it was. The bill was sent to my company who then paid it. I then filled out a transfer of ownership form late 2008 and sent it off to my company and heard nothing back. Jan and Feb 2009 the company was going into administration and after Feb the company was no more. The company was an American company based in California. So I am stuck between a rock and a hard place. I would appreciate if you read my first post to get the history of this all but I would appreciate any advice on here as to where I can now go with this. I am tempting to say to them take me to court but If this does go to court will this be thrown out? Thanks Nigel

                              I suspect Carter is no longer involve as when Lowell restructured Lowell Solicitors was formed and Carter returned the claims to the particular Lowell companies concerned.
                              The point that the invoice was paid by your employer and you say they paid it, could there be some confusion over the company name and your name.

                                Sorry I should have made that clear these iPhones! I sent them the bill and they sent me the money back but after December 2008 finished Jan and Fen bill they never sent the money as the company was being wound up, I spent a few months not knowing if I was going to be able to pay the mortgage etc. Do you have any ideas what I can do now? The company no longer exists and I would like to know what investigation they carried out!
