        for what it is worth I have sent the follewing to the court "I wrote to the court stating we had not and do not agree to the consent from B W Legal nor the conditions on it, stating we would like the case annulled as per the application, the claim was statute barred and we had proved this to the court. Also our rights
        We respectfully request that the Bankruptcy Order be annulled as per our application.
        The Insolvency Service to resolve the registration of the petition as a pending action at the Land Charges Department of HM Land Registry and of the Bankruptcy Order on the Writs and Orders affecting land at the department be vacated.
        Also all our rights be respected in all other matters resulting from the order.
        Also our right to claim expenses and costs be recognised and instated

          I am really not sure what the point of your post was.
          You have been asked questions but not answered them
          What will this achieve..should the court accept your application...you will be awarded some costs but my guess is that they will be reduced because you did not settle when you had a reasonable opportunity to, maybe PT of Cel would confirm if this is possible and/or a risk

          My understanding is that if a judge rules as claim as vexatious they can award costs against you even if you win so your relative could end up owing more than they started with. Whats the going rate for a barrister...£300+ per hr +Vat and a solicitor £200 ph +Vat. Costs soon rack up and I am sure BW would then enforce BR

            Perhaps it would be better to ask you why you think you are automatically entitled to costs when you are the losing party?

            The general rule is that costs follow the event in litigation so if anyone is entitled to costs it is BW Legal as matters stand.


            I do not understand why you refuse the conditions in the order that BW legal offered, unless your claim is one of costs only and if that be the case then your claim is reckless , sometimes you have to accept that costs are not going to be paid to get the right result.

            If you look at this week, Cel has settled three stat demands and none of them provided for costs, but if you ask the clients if they are happy with the result none will moan about costs thats for sure.

                    im aware of that, but there is no mention of the Court of Protections involvement in this matter, nor is there any mention of the Courts appointment of a Litigation friend.

                    Also was an N235 filed in this matter?

                    If not, then i stand by the point that this person did not have a right of audience and the Judge while open to some criticisims, arguably, unless he is presented with the correct paperwork to support the views, would have been entitled to reach the conclusion he did.

                      Note the words, "suitability of a Litigation Friend to act for a Claimant must be confirmed by the Court"

                              Quite possibly CC. BUT I rather suspect the Judge could see that the OP's conduct had positively harmed the defendants case and clearly did not want him to do more damage.

                              To focus obsessively on the non-compliance for disclosure of an earlier Order was a grave mistake here. I had a case a few weeks ago when Cabot consented to set aside a statutory demand but REFUSED to pay ANY costs. They dragged it in front of a deeply unimpressed Judge who quite literally threw the book at them. Full costs plus full CFA uplift of 65%. OUCH!!

                              Our County Court system is in absolute crisis right now. Partly due to a flawed restructuring based on the woeful assumption that the MCOL call centre could cope with demand. It CANNOT

                              This means every case that can be settled, MUST be settled or you risk a furious Judge and a Costs Order against you.

                                Maybe it's a case of a little knowledge is a dangerous thing , or maybe someone from some other site who is unqualified has been egging the OP on so the site can prove some case law at no risk to themselves. To be clear, I am not suggesting anyone or any site in particular

                                Another possible issue is that the medical condition you describe may not be the terminal illness but a symptom of the illness. Seems to me it is akin to jaundice...jaundice is a symptom of many different illnesses
