  • Reliable Collections/1st Credit Letters

    Hi LBs I'm new on this so if I've done it wrong apologises, I've read through the forums and various threads. Especially Tools on Candid Collections (very helpful by the way) thread. I've already CCA'd Reliable Collections and put the account in dispute due to unsigned agreements being sent to me. And with 1st Credit they sent me a CCA which had a signature that looked like mine on one page and some Terms and Conditions on a seperate page. The 1st Credit account is also in dispute. I have attached the letters in hope that someone can give me a bit of direction on how to proceed, as Reliable Collections don't acknowledge the account being in dispute and 1st Credit have given me 4 options on the letter that came with the CCA which I have attached.     What is the alleged debt, I mean who is the original creditor?

      The reliable collections one will be a JD Williams/ Candid Collections mail order catalogue. They are the in house DCA.

      Are you saying the whichever catalogue it is has now passed it to 1st Credit?

        Hi ZB and BB, no reliable collections is totally seperate from 1st credit, two different debts in dispute. The Reliable OC was Simply Be and the OC for 1st Credit was MBNA. I just don't know what to do next with either of them. I'm inclined to send another AID to both and not reply again (well apart from oft, ts and fsa agencies), but sometimes it's better to get a bit of advice prior as I've already read on the forums.

          So two issues, need to know where you currently stand with them.

          1st Credit - MBNA
          - Loan for £5k - agreement looks ok.
          whats the current situation with this one? payments up to date ? £££ of debt ?

          Reliable Collections - Simply Be
          - catalogue purchases
          whats the current total debt ? mainly purchases or interest/charges ?
          A CCA request wouldnt put the account in dispute. Can you put a copy of what they sent you in July up. You'll have a good idea on this one from Tool's thread, but will be able to help more once we know where the debt is at and what you want to acheive.

            1st Cred - is at the moment in dispute and it has been since 22 Jul 10. I only got the copy agreement friday just gone. My only concern is that they have a signature which is fine, but they also have another account for me and I've not had a CCA reply on it yet. So i'm afraid if I say yes thats me, the signature may get used. As I know I didn't sign an agreement for the other pending CCA request. The amount is for around 3k give or take. Because it is from 2001 I couldn't tell you if it is just the debt (or if it includes any charges). I'm tempted to SAR the DCA to keep it in dispute (as I'm waiting for a bit of money to come, so I can do a F&F settlement when it arrives) so I can see charges, NoA, DN etc as I honestly don't remember getting any of that stuff all those years back. I do know that it is past the 6 years point and the debt is no longer on my credit file however. Well that's the state of play with 1st Credit (MBNA loan). I'm happy to pay my way but I don't want to be paying all the unfair charges etc on top.
            Unreliable Collections - This debt is my OHs, its for purchases and loads of charges. The account is also in dispute as of 22 Jul 10 aswell, however Unreliable beg to differ for the letter that is on Post 1. The original CCA request was end of Jun 10, so in my eyes 12+2 had definately passed from delivery signature. I'm also happy to pay my way on this for the OH however with all the charges that they have heaped on there they can poke it. I also have a statement saying that Simply Be (OC) owed the OH £500 but they never took it off the balance. The current balance is £1800ish, however what with charges and the £500 they owe, I think it would be more around £1000. Again, I'm happy to keep it in dispute until my money comes through for a F&F settlement request to go in. Saying that looking at Tools thread and IMO the unenforceability of the CCA, I'm also quite happy to not pay them anything. Right that is pretty much it attached is the CCA they sent me in July 10.
