    Hi Pandora,

    Thanks for popping in to see how I was getting on

    I did recently receive an unprompted offer of a greatly reduced Full & Final settlement from Lloyds on this current account, but as it is currently under investigation by the FOS in connection with another complaint, I have ignored this offer for now. Promise to try to remember to update this thread when there's any news!

          Did they send you any CCA on this one or anything in relation to your account, will have a read through your thread later on though if you don't want to go over all this again lol. (Have some visitors who will be going home shortly).

            Yes, I'm fine thanks - hope you are too? Thanks for taking a look for me!

            No, it being a current account they've sent nothing and there was nothing in my SAR relating to it, but the account was opened quite a few years ago - 1990s.

              Mine was opened in the 90's with them as well, glad I don't bank with them anymore though, and at least the bank we bank with now have been very helpful, well compared to lloyds anyway lol.

                Hi there,

                Thanks to everyone for their posts -they've been really helpful. I've got two questions. First, will the EU directive be retrospective and, secondly, what's the position if you started with a small overdraft which was then increased over the years on the phone without anything in writing? I'm with Lloyds as well and they're chasing me even though I'm unemployed and their charges are making my overdraft get bigger!

                Sorry if I've posted this in the wrong place, but I'm sure someone will help. Keep up the good work.

                  Just popped into see how Nells was doing .... seems quiet so that's good.

                  To Stoney, although the revision may have been conducted orally, IMHO they would still need to send you formal (written) notification of what your revised OD facility had been amended to.

                  About the EU directive .. shall have a look at this and get back to you on that if I may .. try Peter Bard esq - he's generally v good on the legals ...

                    Thanks for popping in to see how I was doing - that's very kind of you

                    Yep, don't want to speak too soon, but all quiet on the western front in relation to LTSB - am awaiting some LTSB PPI/other updates from the FOS now that the JR appeal is not happening, but we're also busy moving (hopefully, if our exchange ever happens, lol!) so have been a bit caught up with packing/planning removals etc.

                      As it probably did not originate within the UK, its implementation is likely to be grudgingly patchy and painfully s-l-o-w.

                      Only EU directives that started as a clever idea or cunning plan by a civil servant in the UK - and then were disguised as an EU Directive as they would/could be unpopular - are ever implemented fully and quickly.

                          Hi Stony,

                          You need to very careful about retrospective laws and directives. It is a fundamental principle of the Lisbon Treaty for all EU citizens that you cannot be disadvantaged by any retrospecticve law or regulation. This is one of the good bits in general for us mere mortals that our political betters could not sign us out of. However it must be applied even handedly and also applies to the opposition as well.

                          I believe it will become or be moulded into a very complex issue in the end.

                            THese ammendment will apply to all overdraft agreeements, (that does not mean the bank agreement of course, that would be unregualted anyway) executed after Feb this year.

                            I think they will be a great improvement to the previous system, all overdrafts issued to our European cousins have had this provision for some time.
                            I thnk you will find that current account agreements will have a CCA section contained within them to if they intend to prvide this facility from the approved date.
