  • CCA Agreements - any results?

Well, its now the end of November, well and truely. Has anyone got any positive (hopefully) feedback from any test cases to share with us? I know we have been all focusing on the bank charges story this week, but onwards and upwards.....

havent heard anything as yet since the bbc story on monday, but then I havent been paying much attention this week - BBC News - Credit card debt cases face showdown - if you find anything will you let us know - i'd expect Cartel to have something to say on the matter as a number of the claims were theirs.

Well, we didn't get to court on any of them!! Few adjournments, a number of off the record settlements (confidentiality applies) and a couple struck out on the record which we can publicise, both around £25k written off. Will let you have full details when clients have agreed to the wording.

Was that case not a few weeks back - £8000 written off. Or are these another two claims?

On 18/06/09 in the Barnet County Court we successfully struck out £5643 for our client against CL Finance on behalf of Barclaycard. The agreement was unenforceable.

On 28/10/09 in the Ilford County Court we successfully struck out £8415 for our client against CL Finance on behalf of Barclaycard. The agreement was unenforceable.

On the 13/11/09 a high street lender (who we cannot name due to confidential terms) agreed not to enforce or pursue our client for £24,490.The agreement was unenforceable. This settlement took place the day before the court trial date and the lender paid our costs.

Ouch that's going to hurt CL bottom line.
Also I'm willing to bet the assignment wasn't compliant as well..

By the way who was the Judge at Barnet?
