  • Goodwill offer from Barclays - what next...help!!

    Hello everyone,

    This is my first post here so please bear with me !

    Im claiming £2675.00 worth of charges which Barclays have charged over the last 6 years on an account that defaulted last november. Basically i lost my job last year just 2 months after purchasing my first home...as you can imagine i got behind with my bills and subsequently ended up with an overdraft of £2518.00 (my agreed overdraft was only £1000..ouch!)

    So far, I have sent off 3 letters requesting my charges back, the last letter being the LBA. Eventually after a couple of standard letters from Barclays stating that they're 'looking into my complaint' i recieved a letter back from them just over a week ago offering me £2000 as a gesture of goodwill, but the money will be used to reduce the outstanding debt i have with them. It goes on to say that i have 8 weeks to respond and asks me to sign to accept the offer.

    I'm in two minds what to do because, yes it is great to have £2000 knocked off my debt with them and only have £518.00 left to pay but the charges i am reclaiming amount to £2675.00 so really they are making money out of me.
    I was thinking of writing to them and requesting that they repay me £2518.00 and use it to wipe the debt i have with them and request that they remove the default from my credit file.

    Do you think is reasonable? What are the chances of them accepting this?

    Any advice would be greatly appreciated!

    Glad you made it over.

    Yes once you file at court you can add 8% onto each charge.the older the charge the more interest you get..

    I would go for it.

      Hi Classylady,

      Trust me on this, Barclays are slower than something that is really slow. Don't waste your time writing to them anymore. File your claim.

      Whilst you have received a good offer from them, it is not nearly close enough. Have you done a spreadsheet that calculates 8% interest? If not, I suggest you do one and you will then see just how short of a satisfactory offer that actually is.

        Im really worried about taking it to court though in case i lose and end up still having a debt with Barclays. But i have come this far so i think i'll send a letter asking them to wipe my debt, if no luck i will take them to Court.

        Are there any templates i could use to help me write the letter?

          The other question is do i have to pay court costs when i file my claim, because at the moment i do not have any money to pay for it??

            ok Deller thank you for your advice, i think i need to save some money before i can claim through the courts, the letter from Barclays say's i have 8 weeks to respond so i have a few weeks left to save up the money!

            I will keep you all posted on what happens!

              If you can show the court that to pay these costs to bring the case would cause you hardship - no.

              Court Fees - do you have to pay them?

                Thanks Amy, it would definately cause me hardship as i only have around £40 a month left after all my bills and debts are paid!

                I will contact the court for some advice on exemption from these fees.

                      Hello! Im back again!

                      I've got a couple of questions that u guys may be able to help me with:

                      I've decided im not going to accept Barclays 'goodwill offer' (lol!) of £2000 and instead im going to claim for the whole amount plus the 8% interest.

                      1.) Shall i write to them rejecting their offer and inform them that i will be claiming through the courts for the full amount plus interest ?

                      or

                      2.) Shall i just file the claim with the courts without further notice?

                      Im unsure what to do and times ticking away!

                      Any advice would be most helpful ....!

                          I would only give them a further 7 days to repay in full.

                          Have you filled out the spreadsheet yet? You should send a copy of this with your rejection letter.
