    Sent letters asking for charges back....Nutwest reply was "were passing your details to our legal team!"
    So I filled in N1 form, submitted evidence and filed!
    Got offer after a while for amount and costs, but has gagging order attached. As well as threat that if I don't accept this 'Gesture of goodwill' Nutwest will change my account to a basic one!
    I rejected this offer and politely told Cobbetts where to place the offending offer....lol
    Hearing date is 27th June....
    So just getting ready for that now....

        Well just remember really the whole basis of what you are trying to prove.

        a) the fees are actual penalties for breaches of contract, and NOT SERVICE FEES
        If you can prove that one, youre basically home and dry.

        Plenty of paperwork and other cases etc. to quote to prove that point me thinks.

          News flash........lol
          Cobbetts called late friday afternoon and spoke to my fiancee...
          They told her that they Urgently needed to speak to me to discuss an out of court settlement??
          Strangely I had spoken to someone at the court yesterday who told me the judge was fuming over the letter that I had received threatening to change or close my nutwest account if I didn't accept their Goodwill Gesture.......
          Just wondering if I should ask them for costs for ink, postage and £9.50 an hour for working on paperwork?
          Also compensation for the failure to fulfill my SAR's request...any idea how much to ask for??.......lol
          I also am going to ask for charges plus interest at unarranged borrowing rate 29.6%.....lol
          All opinions greatly received........lol

            veilside hold the unarranged borrowing rate bit because you would be shooting yourself in the foot as the ubr rate was higher at one point. How long have you got?

              Just had call from natwest collections dept......
              They want me to pay them outstanding balance on overdraft as it has been pushed over the agreed amount by their own charges....lol
              I told them to put this in writing......and that they owe themselves the money in charges....lol
              The woman I spoke to was very rude and abrupt.....lol
              looks like they are going to try and submit legal proceedings to recover what they owe themselves.....lol
              advice on this would be appreciated again......lol

                  hi nattie.....hearing is on 27th june.....
                  But court is now looking at prosecuting cobblers and nutty as well for the letters they sent out.....lol
                  Also got them on the SAR's failure....lol
                  Just not sure what to ask for for costs and compensation???

                        tell them about your claim for charges and that when it is dealt with they will get their money

                          I rang and told them, they made note on the system....but the guy said it was a different dept and they don't work together.....lol
                          So am putting account in dispute letter together for monday posting....lol
                          He said they were going to default stage.....lol
                          yet another thing to take to court with me.....lol
                          As my overdrawn balance is less than they will pay me in charges and interest.....lol
                          and it is over the overdarft limit due to their charges being added.....lol

                            if you put in a letter stating the account is in dispute they cannot put the account in default. I have read a few cases where they have held the account for 28 days with no action until the issues of court action has been dealt with.

                              Just doing letter now nattie....lol
                              Have also added reminder that they are about 20 days over SAR's 40 days.....
                              and that they took my benefit in penalty charges for 3 years.....lol
                              They also keep calling me and asking for my first name and not disclosing who they are!
                              oopppsss.....lol
