As for the Compound interest....would have been nice to get.....but didn't put in original claim application.....so could cause problems....??
I sent a letter to the court, cobbetts and natwest asking for the judge to respectfully consider using it....if not then the courts 8% would be fine....lol
Thinking of settling just for the peace and quiet......plus I can spend more time advising others not to do as I did.....lol

Well Im pretty sure if you accepted, they would add

IN FULL AND FINAL SETTLEMENT, rendering you unable to pursue wasted costs or compo. But it has to be your decision veilside. I would accept, but only because Im tired of the whole dragging out process, but it really is your call my friend. Only you know what you want to do. The contractual thingy would go against you in court if you hadnt asked for it from the outset too. And the last thing you want is to have waited for a court date, prepared your bundle, everything else involved etc. etc. only to find judge doesnt award contractual anyway.

I can only say what I would do Russ. I WOULD SETTLE FOR WHAT THEY HAVE OFFERED. TRULY, I WOULD. Give yourself a break from the fight man. Settle and get the money quicker. Fendy xxx

sounds like good solid advice to me! I know nothing about contractual interest though! looked at the form and it scared me silly.... LOL
if the amount is inc 8% also inc court fee's then I'd have to consider it.
Maybe see if you can negotiate a little on the cost's!!! possibly drop the compenstaion. if she see's you're willing to comprimise you may well still get a settlement.
just my own personal opinion, please don't feel that you should settle for a lower amount if you want to carry on and fight it!

I think that I may be on the TAKE IT AND RUN side at the moment, if you can get off them the total for the charges, 8% doodah and the court costs, then I think I would be happy with that. I mean they are only paying back what you have shelled out (the charges and the court fees), the 8% is in some way the compensation for it all.

Well that's my way of looking at it, but if they offered me those 3, then I would bite their hand off as that is all that I am wanting from them.

But the interest Nutty would charge me if I borrowed the money from them without asking for it...

Veilside, only my personal opinion, but I firmly believe you have saved yourself a very long drawn out fight. The end result is you would have won anyway, but would you have been awarded contractual or Stat.S69 basic 8%. ??? That my friend we will never know. But I do think you are doing the right thing. Can I just add something after reading that post, contractual is what you say they would have charged you had you borrowed without asking, well fine I see where you are coming from..... but why lower yourself to the same low level as the bank? All you want is what is yours, and if they adopted that same principal then we wouldn't all be here claiming would we?

I can fully understand the 'do unto them' theory, but you are better than a faceless corporation. And a damn sight more reasonable!

Well ring them and make a payment arrangement with them Russ and if they starting banging on charges again, just go for the throat again. Only offer what you can genuinely afford, no more, and explain your financial situation about benefits etc, so they will have to agree to it.
