    Hello all,

    I have sent my leter before action to the Halifax - 2 weeks are up 11.06.07 - going to give them until 13.06.07 (due to post etc) and then what? list it at court or call and try to get them to settle?

    After the 14 day expiry of the LBA deadline you should file a claim at court straightaway. Once you have filed the bank starts taking you more seriously and even better you get 8% s.69 County Courts Interest on top!

    Have you done the spreadsheets and sent them with your letters?

    You should start preparing your N1 form now. Have a look in the templates library, there is a great N1 completion guide. Also have a read of our FAQs to familiarise yourself with the court stage of your claim.

      Thanks for the reply, no not completed the spreedsheets - sent a copy of the shedual they sent me to them. I will do that today.

      I have read FAQs, I will co the Spreedsheets and N1 today and list the case at court.

            Well, I started my court case, bank deemed served 22.07.07 - (before Test case was lodged) wasnt sure what would happen - called the court - they are going ahead with cases lodged at present - called the bank - they didnt know what they were doing - today i received a letter stating that the intend to defend! what happens now i wonder?

              halifax did exactly same thing to me then 4 days later the whole claim of 5.5k was put in my account and 3 days after that they sent me a nice smarmy letter saying it wasnt economical for them to defend in court and that I was being given my whole amount back as goodwill gesture...............So hang on in there mate...............Let em sweat!!!!!!!!!!!!

                  mine was settled in november and it was listed mate............dont be put off really you got nowt to be worried about...............and in my experience and that of others halifax have been pretty decent to deal with.............keep a check on your account as they listed mine and at same time paid FULL amount into my account........But please remember I can only go off mine and just because mine went straight forward doesnt mean yours will...............So please dont go off what happened to me as gospel.............I dont want to give you any false hope mate thats all...........

                    Just though I would give an update on my case. received defence from the bank today - doesnt mention anything about "staying" the case - although I suspect that the court will do this in any event. The bank had until 20.08.07 to lodge the defence so I guess now either one of two things will happen:
                    1) The bank will call and make me an offer.
                    2) the Court will stay the case.

                    I have just spoken to my court:
                    Eastbourne County Court,
                    The Law Courts,
                    Old Orchard road
                    Eastbourne
                    East Sussex
                    BN21 4UN

                    They have issued a blanket stay on all bank charge cases (all interest stops now as well by the way) until the review date MARCH 2008:devil: They have said that each case goes to the Judge for consideration, but they have all been stayed so far, she also said that I can appeal the stay but it will cost more money and she advised that it would ber highly unlikely that I would win the appeal.

                    This is so unfair when you consider that I have been trying to get the correct statements from my bank since last October - I still dont have a compete set AND my claim and court fees were lodged beofre the 27.07.07.

                    Any ideas about what to do next? and any ideas when the court ruling might be made on the OFT test case?

                      Well I'm no expert on this, but I wouldn't worry about it being stayed till it actually is, if you see what i mean. You may be lucky and it may not get stayed.
                      In the meantime, as you've just received their defence, is it worth a call/email to them to negotiate? You never know, it may work, especially if they don't yet know that the case might be stayed, you might be able to sneak in under the radar!.
                      I must confess I don't know how the Halifax work, or indeed if their left hand knows what their right hand is doing......my two claims were against Natwest so you might want to get the thoughts of more halifax claimers before deciding what to do.
                      Have they made you any offers at all?

                        Hi Wendy.

                        No they have not made me any offers nor I them - I am hoping other Halfax calimants will contact me soon - I will also contact them.

                        When you mention call and negotiate - would that be to the bank or the solicitors?

                          Either I would think, if you get the wrong one they'll point you in the direction of the other one!
                          As I said, I don't know whether this is something that Halifax are willing to do or not.

                          Just thought that if they'd already made you an offer, you could always use that as a fallback to get your dosh, if it was a reasonable offer....but if they haven't, then thats no good.
                          Try and get some veiws from more Halifax claimants...

                            Check out Actionplans thread, Halifax claim settled. Might give you some ideas...and there's another one by Max which is quite encouraging as well, from a Halifax claimants point of view I think. Although it might have changed now since the OFT, stays and all that.

                              Just to let you all know - there is an E-petition on Martin Lewes's website - for Gordon Brown to get involved and either lift the "blenket Stay" or inforce that the banks lift the charges until the out come of the OFT test case - TELL EVERYBODY YOU KNOW TO SIGN UP.
