    Probably standard stuff re different judge etc.

    What you have to remember here is YOU ARE RIGHT, THEY ARE WRONG lets spend the next couple of weeks making sure you have every answer you could possibly need, think up every question they could possibly ask and bury this one once and for all.

    You already have a list as long as your arm of their failings, you need to make sure the court are aware that Cobbetts think they are way above the law and can get away with anything they want - nobody likes the p*** taken out of them - especially a judge I should think.

      FSA's newsletter dated 27th July 2007 did state the following:

      Consumers who are in very difficult financial circumstances - 'hardship cases'
      Banks and building societies will have to conduct a filtering process to ensure that cases of genuine hardship are still dealt with during the waiver period. Cases of hardship would still be entitled to be referred to, and dealt with by, the FOS.

      whether this applies to the courts, who know but if FSA have stated these cases be dealt with, then so should the courts.

        Right TBH I don't think the judge will strike them out before the hearing. So we need a nice skeleton argument and make sure you know what you are arguing for in court.

        So...we need to understand the inalienability of benefits - why they are - and that they belong to the state. The hardship case has just shot up really with the loss of both of your jobs...I'm wondering if it is worth writing to the court with details of this change in your circumstances.

        The consequences of not getting this money in....make sure you have paperwork to back up your incoming and outgoings etc. Financial breakdowns incomings outgoings etc to demonstrate your current position etc.

        we'll try and have a good chat though it all with you and tools on skype at some point next week. We also need to go through their application, and original letter to the court asking for the stay with a fine toothcomb and make sure we answer everything.

          sounds like a plan to me.... I'm not afraid to admit I'm bricking it!! ..... NOT looking forward to the hearing at all!!

          I haven't heard anything from the court yet, since sending that request in..... but I think you're right.... I doubt very much at all now the hearing request has been granted they will even consider striking out.
          I may give the court another ring though and ask when I can expect to receive some details from Cobbetts in light of the hearing.... what do you think..... ring or leave it?

            leave it - though can you confirm the hearing dates you have...I have in my head 23rd for stay lift appeal application hearing and 25th for full charges hearing?

                Right can you PM me with dates u lost your job, date OH lost his, salarys lost, benefits you have applied for etc etc.

                We'll get a letter to court for change of circumstances and also for cobbets.

                We are bevering away on bundle for 23rd hearing for you which needs to go in 7 days before and just bashing things between us before going through everything with you. Also skeleton arguments and the evidence u need. Should be able to go through it all tomorrow or thursday with you.

                  dates have been sent to your pm. and a breakdown of financial mess we are in.
                  benefits are still going through... again... so no idea what we'll be left with at the end of it..... one thing for sure though.... if past experience is anything to go by......not enough!!





                  and i'm rapidly running out of things I can sell to help keep us afloat!

                          Cor, just catching up tempty.

                          Good news on the hearing on the 23rd hun. I know it's daunting but hopefully it'll all be resolved sooner than later, and that alone is worth celebrating.

                          Just incase I'm not around (sons birthday bash to organise) i'll wish you all the luck in the world. Will check in to see how you're doin:okay:

                            Well just over a week to go and no surprise still not a peep out of Cobblers!! Can't say I'm expecting to receive anything either TBH wonder if they will even turn up!
                            obviously I'm preparing for them to be there....... gotta get my head straight and get ready to fight .... sharpen the tounge (but not too much) lol ...... don't wear expensive clothes ...... lol no problem there..... haven't got any. know what your talking about...... erm ok got most of it straight i think Ameeeeeeeeeee, Toooooools need to go through things when you get a min...... I'm not panicking....honest.... LOL
