  • Kafka v GE Money

    This was originally a finance agreement for a PC with First National Tricity Finance, started in 1999.

    With only a few hundred owing it was passed to Moorcroft, who defaulted it in 2003. The account was soon paid, but the default still stands on my credit file until next year.

    When I checked the statements there were more than £300 charged just for sending letters at £20 per time.

    The account has since transferred to GE Money

    A Prelim Letter was sent early in Jan.

    They replied last week with the usual garbage and are refusing tp repay or remove the default.

    LBA goes tomorrow :fencing:

    Well they have replied again with garbage.

    Usual crap about quality service and concerns, saying they will respond within 4 weeks.

      wot was the account balance at time of default issue?
      what value of charges were on the account at that point?
      was the £300 in charges added after the default issue?

        Default figure 235

        Charges of 345 added before this for letters.

        In other words, the default was all for letter charges because the account had actually been more than paid off by then.

            I've had a claim (actually four) against GE, and they were reasonably easy to deal with.
            I've started a PPI claim against them now, so hopefully they will be just as easy to deal with.

              Now received a typically cocky reply from GE Money.

              Usual crap about agreeing to pay charges.

              "GE Money is currently reviewing the OFT's recent publication of its findings into default fee charges. Our view remains that we are entitled to charge these fees (which is consistent with the OFT's view)."

              "Refund of charges under the OFT ruling is only applicable for the last 6 years, from February 2002 to the present day. Unfortunately, this ruling does not cover loan products and therefore all charges are applicable."

              "With regards to your request for a breakdown of cost, I can confirm our cgarging structure for late payment charges is privy to GE Money business and will not be disclosed."

              I now need to file N1 for this, but its for a different type of account than I've dealt with before. Any suggestions please?

                Suggestions for what exactly??

                disproportionate penalty charges are disproportionate penalty charges in my book no matter what account it is unless they can prove otherwise :whoo:
