    Hi all, Quick question

    Can my bank (HSBC) legally withold a child tax credit payment from us if we are overdrawn?

    I ask because we need the money to help feed our children untill the end of the month, and HSBC are being very reluctant to let us have any of it, even though they are aware that it is for the children. I would like to know the legal point of view on this matter before I approach the bank and start demanding the money from them.

    Any help or advice on this matter would be greatly appreciated.

      Steve, presumably you mean that they have taken the money in charges? If so then no, they are not allowed to do this, but then they are not supposed to charge £39 for not paying a Direct Debit either.

      You should set up another account as soon as you can for these payments to be made into.

        It is a case of arguing the point to get this money - get your child tax credits, and child benefit money paid elsewhere - such as a post office account that you can use solely for getting this money out of.

        There is some thing called right of appropriation, although its not meant for retrospective use if they havent taken the charges yet it might help make them see sense. Theres also the argument that child tax credits are inalienable which you could also try using on them, if asking gets you no where.

        I'll grab a couple links for you to read which might help if you go see them or phone them again to make your argument stronger.

            you say this is cuz you are overdrawn. Is that the only reason or is the reason is it to pay for an accumulation of penalty charges??
