Additional Terms and Conditions for First Reserve,
Diamond Reserve and Reward Reserve Accounts
    Operations on the account
    • Lodgements for any amount can be made by Bank Giro Credit at any
of our branches or at any other bank. A small direct charge for this
service may be made by any other bank. Wages and salary
lodgements are not permitted on the account.

    • Standing Orders and Direct Debit payments are not permitted from the
    account.

Additional Terms and Conditions for First Reserve
    Availability
    • The account is available to private individuals and trustees as a
personal account only. We may write to your parent(s)/guardian(s) if
you are under 16 to advise that an account has been opened.

Can't find anything else on off-setting debt on these T&C's.
But it does state the above, so any salary should not have been deposited into that account anyway, it seems THEY are in breach of contract.

One more point I'd like to make, It seems that no electronic payments in or out of the account are allowed. So that would include the bank taking money electronically as well

sorry i meant to say electronic payment from employer.
it's a personal account with no provisions for wage or salary deposits and with no D/D or S/O payments allowed.

they shouldn't of allowed his wages to be deposited.
Were they deposited electronically or did you deposit cash over the counter?
          cuz that is allowed

I can't see anything their terms and conditions that allows them to withhold your own money.

the lady on the phone wasnt helping at all she wasnt point blank going to let my patner have his money nor would she re-open my daughters account (they have canceled her card ) she said he was to make a agreement to pay monthly to his o/d and then she MIGHT let him have some .
he past the phone to me cos he was losing his temper and i read out the t and c to her that they had breach and she said so had partner .i agreed he had on his own account but not this one and she said but it is linked because his name is on it . wasnt getting anywhere so i told her we would take this further ..

Re: transfering money from one account to the other ?

Some banks have it written in to T&C that they can use money from another product in your name to pay another product in your name.

Best for the future now is i always have money in one, if necessary would borrow from another, and i would never ever have my mortgage in the same place i bank again. I'm lucky i signed 3 years ago but any C&G (now Lloyd's) mortgage is now linked like this to all of your accounts. They certainly don't do them selves any favors.

Regarding joint accounts, I know the benefits agency class joint account as anyone of the users to be owning its contents at any one time. So they may be in their rights to do this, providing you do owe the money and all letters requests have been issued surely they gave you some notice the OD was to be recalled? didn't they

have a read of Grimbells thread see had a right battle last week! and she doesn't owe any money

Hope this helps a bit, i couldn't get clear record of whats happened.

There is no reference in the T&C's regarding off-setting debts from another account and according to T&C's, Electronic transfer of wages or salary in to the account is not allowed.
Guess wot? the money they took were wages that were electronically transfrred into the account.
