  • Cadence vs Lloyds ??? possibly

    Hey there,
I admit now Yes i am a hauder and have kept all my bank statments in 2 file boxes upstairs for years, and its a habit i haven't yet kicked!
I had an account with Lloyds TSB for over 7 years and because i was silly and young i ended up getting charged £39.00 at least once a week for unauthorized od or bounced chq.
I have looked briefly through my statements that i have and me and my partner have calculated over 9000 in charges for chqs etc.
however i stopped using this account in 2006 and had to pay about £160 pounds of unpaid charges to AKtiv capital.
Needless to say i have had no dealings with them since.
Can i still laim back these charges? as i am not sure of the time frame i have to do this.
    Please help

First thing to do is have a good read of this Important - full Legal Opinion and update on LB's position on bank charge reclaims - Legal Beagles Consumer Forum and relevant threads and decide if you want to continue with trying to reclaim charges.

Theoretically yes you could reclaim on both a closed account and one that extends back past 6 years - so neither of those points are an issue

Nothing at this stage no, see how it goes, but think VERY carefully before you get to any court stages. Hopefully before you get that far there will be further progress from cases that are in the court system at the moment.

Were you in any financial difficulties when the charges were being applied ? and had you spoken to the bank about this at the time ? (just another angle)

I have never had any contact from the bank themselves other than, the lovely letters telling me i have overdrawn or they were unable to take for a cheque as i was 1p short! lol. I was a single mom on benefits at the time i have never had credit of any type so i don't believe i was in much financial difficulty other than struggling to pay normal bills etc.

Thanks, well thats that avenue out the window then. A standard reclaim of charges is very difficult in the present climate as I said before, so if you can wait, I would recommend it, feel free to write to the bank and have a moan, but don't expect to get very far - that sounds awfully defeatist but its just how things are at the moment...once some of these cases get heard in court we'll have a much better idea whether it is worth the time, effort and money fighting for redress for historical actions of the banks.
