      Re: Ms Owe-A-Lot vs HSBC

OK, is the court fee then worked out on the £500.- and not on the £500.- plus interest ? Because the £4.69 would knock me over into the next fee bracket

No the value is £500 not including interest, confusing isnt it?
The court decides whether you get the interest really so you dont include it in the value, ive just checked on one of my N1's i keep them for reference cos i forget lol

I have brought the N1 template back up on screen and there is no field to put interest separately

There is the value field, then amount claimed, court fee, solicitors costs and total amount
So I am always wondering where to put the interest....

OK, so I put value as £500.- , amount claimed £500.- and then the court fees and just mention the interest claimed as per section 69 in the POCs ?

on the front page you have VALUE underneath you put unlawful charges £500.00
under that you put interest under s.69 county courts act 1984 £4.69 under that court fee £45.00 under that total £549.69

              then AMOUNT CLAIMED £504.69
              under that court fee £45.00
              total amount £549.69

              ok?

                    Re: Ms Owe-A-Lot vs HSBC

I have just noted they are also adding a lot of new fees to the old ones as from October.
There will now be a hearing fee, even on the small claims track.
So the initial fees are getting lower, there are new ones to make up for it.
So I think I will wait until October to start the claim to at least get the cheaper initial fee, otherwise I would be paying the higher fee in September and still end up paying the new additional ones that come in from October. Seems better to wait then.

Also found the thing I was looking for in the county court fees rules

"Where the claimant is making a claim for interest on a specified sum of money, the amount on which the fee is calculated is the total amount of the claim and the interest."

That means my £4.69 interest will indeed knock me over the fee threshold
How typical, I will wait until October so it only costs me £60.- rather than £80.- although many more fees will then come creeping along on the way to success.....

Dont bother with the interest then, its not too much anyway is it?
Or look at it the other way, whatever you pay in fees they'll have to pay back anyway!
