      contacted recorders court today. i was informed that the matter was set aside in feb 2008 and on 20 april 2009 the matter was 'struck out'.

      received in post today letter from bailiff & debt recovery agents requesting 400+ outstanding bank charges from 2007.

        Was it struck out in 2009 or 2010 ?

        If 2010 understandable, if 2009 I would query the reasons.

        You should have received something from the court or the bank about your case being struck out, unless the stay was due to end on a certain date and without action it was automatically struck.

          the court worker definitely said april 2009 when it was struck off - i wondered about that to as the test case was still ongoing. i did not receive any correspondence from court or my solicitor on the matter, following the court case??. looking at correspondence from sol at the time dated 28 feb 08 - 'please note a Decree has been granted and i am currently awaiting a date for assessment of damages' thats the last correspondence i received from solicitor.

            You'll need to get copies of the paperwork from the court - you should have had papers to defend setaside and stay (not that you would have defended it but still should have had papers) and also the strike out application and/or notification.

            Have you moved since Feb 08 ?

            Wheres the solicitor now?

              i didnt receive anything nor have i heard from sol since the court in 2008, i left the matter waiting for the outcome of the test case and as i said before my colleagues commented that more or less the matter was finished with when the test case was thrown out. i havent moved house - Would you recommend that i write to the court - and could you advise me how do i handle the Phillips clan [debt collectors]. i feel as if i am going round in circles and becoming thoroughly pxxxed of. putting all this aside do i just accept what has happened and leave it. thanks for your help.
