    Hi all,
    Everything that my sister has paid into her account is benefits and natwest are taking charges constantly ( she was too scared to do anything about it til i found out) this claim should be rather big.

    SAR sent 12/09/07

    What is her position re income, hardship etc?

    We are looking for cases where we can demonstrate severe hardship to fight the stays. Can you provide some more info please?

      Sorry to intrude ,I have had over 13k taken out of my benefits and need help please ! But I am with Woolwich/Barclays

        I dont exactly know the ins and outs of her account until i receive the statements, all i know is that she went to the bank thismorning to get some money to pay off her sons school uniform and found that her £46.25 tax credit payment had been swallowed up by £76.00 worth of charges.


        She gets IS @ £59.15 per week
        CTC @ 46.25 per week
        CHB @£72.40 every four weeks

        She is a single parent, lost her job 2 years ago and suffers mental health problems.

        I have no idea what is being taken from the bank as the account is in such a sorry state.

        Is this enough or do you need more.

          the best thing is to start a thread in the barclays section of the forum explaining your circumstances someone will be more than happy to help you.

            You may have sufficient here for a strong case for us to fight. We need to first stop the bank plundering the benefits. When she gets the charges details this may well be a case we can fight with her.

              I think you probably need to put it in writing to the bank straight away, and possibly arrange for benefits to be paid into a different account. If you do SAR Prelim etc, then you would have a good case imho for getting a stay removed, if it got that far. You've got Kafka on the case so I'm sure he'll point you in the right direction.

                Hi wendy,
                She is in town now opening a new basic bank account. I have written out 3 right of appropriation letters and told her to hand them in and get receipts for them ready for next weeks payments just in case we cant do account change over within the next week.
                LOL its a good job kafka is only down the road from me.

                  Some people have all the luck......

                  Take care when you contact the Benefits mob...Veilside has had loads of grief with his. Although I have to say when I wanted to divert my family allowance to stop natwest getting their mitts on it the bloke I spoke to was dead helpful. I think that was at the child benefit centre in Blackpool.

                    Another option for benefits is a special Post Office account, where you need a form from the benefit office I think.

                    The person who can advise on this is desperatemary on PC who runs a Post Office!

                      The account at the post office is easy and no risk of charges. I have just started using one, and although i have to pay all my bills now over the PO counter in cash, and can only withdraw cash not pay it in, its suiting me fine and I dont need worry about stupid charges swallowing up my benefits,

                      I had a invitation letter from the Jobcentre when I arranged my benefits which I took in lmy local PO and it took about 7 days to get the account running and benefits paid in to it.

                      But a basic bank account if she can get one is a better idea as you have more options.

                      If the SAR has just been sent we have a fair bit of time to work out the best way of handling her claim. At the moment, and especially judging where you live, a claim through the FOS asking for the case to be considered a hardship case might be wise. This wouldnt preclude her from taking court action if the FOS didnt agree.

                      We'd need more info on her income and debt etc but not yet. Theres peeps looking at it for you now and we're looking deeper into the FOS side of things. So will keep u informed.

                      Let us know what the bank does about the ROA letters.

                        if anyones an advert for what these guy's can do it's me
                        Nastywest had my case stayed, But the guy's here fought it based on the fact I only had benefits going into the account and won!!! the stay has been overturned and i am back on track again.
                        so my advice... hang in there hun.... give em as much info as you can and let them work their magic.

                          Thankyou for the words of kindness and help in this early stage.
                          My sister now has back a little of the confidence that she had lost through years of worry and not telling anyone about it.

                          By the end im sure she will be back to being the young and gobby little darling that she used to be (great lol).

                            Received the statements yesterday i had a quick scan through them and i have a found some that just say DEBIT and they range from £30 to £37 but do not say they are a charges, Does anyone have an idea of what they are?

                              I would think the 30 would be for paid referrals, 37 could be a combination of £9 advantage Gold fee (it used to be £9, its £12 now. I think it was £6 originally) and £28 overlimit fee. There's also a sticky by nattie about Advantage Gold fees that would be worth a look at.
