    You entered your appliction to deny the stay ?? before your claim was stayed ? or had it already been stayed ?

      Hi Tempty

      Yes I am still getting charged even as we speak and my account goes overdrawn with limited or no funds available., and it still overdrawn now.
      The loans that I had were used to live on and to pay various other debts and bills etc...

        she's not had a stay yet ame!
        just a date to attend an allocation hearing.. at which time the judge may decide to stay till after OFT. (from what i've been reading this could be possible) she had already sent in her deny for stay letter. I asked her to post it suspecting it may be the template focusing on the human rights act!... it was.

        The allocation hearing also looks as if it's to decide if her case should be heard as a separate case or with others of similar circumstances. if you remember my case was first scheduled to be in a block hearing before the stay was enforced! Once we successfully removed the stay I was allocated a separate hearing.

        My thought's were to provide her with a more personal argument to avoid a stay (should one be applied for at the hearing) and hopefully push a separate rather then a bulk hearing forward. She has very similar circumstances to me.....could my case be useful to her? can we use my override of a stay to avoid getting one on hers? just some thoughts here.... wanted to speak to you guy's about this one anyway .....lol

          Yes, I submitted my application before it had a chance to be Stayed, and as far as I know my claims are still going forward as normal, the Judges at Kingston are not willing to stay claims (in which I am very thankful for) but then I will find out more atl my Allocation Hearing on the 26th Sept

            good thats okay then I was wondering why you'd asked to turn over the stay if you hadnt had one applied. but forearmed and all that. I don't like the template and I dont like sending it prior to a stay being indicated on the claim. (not you jas - the way the other forums are taking this) It clogs up the courts and means the people who actually need their stay lifts appl looked at will get missed and the courts will be drowning in 'just in case you decide to think about staying my case read this' paperwork. If you get what I mean. More unhappy judges.


            Tempts - yep thats what I was surmissing too so an individual personalised argument as to why bloomingflowers stay should not be stayed would be a good idea for the hearing...If it is that then should she get the opportunity to argue her case - she should have a decent case to argue against the stay.

            In anycase we can get an application ready to submit to overturn if he does stay the claim at the hearing. So think its worth doing. and def to indicate a seperate hearing rather than bulk too....


            Let me/tools know if you would like any help Tempts .... think the argument laid out as a witness statement for Jas to use as notes in court would be ideal .... but work on the letter and appl first (without sending them) then translate the arguments for speaking in court (or handing to the judge).

            Its a bit IF - cause it might not be to discuss stays at all.

            Okay I am waffling sorry. Will have someone else have a look at the order here too and have a wee thinkie.

              Hey

              Had a natter and we think the best way to go is to submit draft directions before the hearing - and take with you your arguments against a stay just incase that pops up. You have a good case for not having the claim stayed so make sure you get that across to the judge.

              oh also regarding this 2k costs - we might sort a letter out for you to abbey to get a breakdown of those costs....to get it out by 20% or more is professional misconduct so if they are whacking it up to scare u it could be interesting.
