    I am in an arrangement agreed with Lloyds to pay off my overdraft monthly. I missed this month's payment (no money!!) and now the buggers want the lot!!

    I have written back (or rather am writing ........ ) to explain situation and that I will make up both payments next month.

    Is there anything I can add along the lines that the account remains in dispute re reclaim of charges and if so what can I say that will make sense?

    Or after reading the FOS decision have we really reached the end of the road in terms of claiming our charges back?

    Be grateful for an opinion here.

    If all else fails after writing a letter there is always the CEO to complain to.

          Looks good so far, yes I would expand on this part



          I dispute that these charges are lawful under the Unfair Terms in Consumer Contracts 1999 and I previously notified you of this in my letter dated XX/XX/XXXX (SHOULD THIS BE IN HERE AND IF SO SHOULD I MAKE REFERENCE TO REG 5(1)????????????).


          IF you have the dispute in and they havent yet written to you closing the complaint use some bits from the witness statements and the FOS and BANKS complaint letter examples. You could also add in some parts from the Lending Code section 9 to point out they arent treating customers fairly etc. Only briefly as this isnt the complaint letter just a reminder that the account IS in dispute and you are being ultra nice by paying them something.

                  OK have revamped my letter to SCaM - have taken out bits that were really only relevant to a reply to the bank.

                  Ames - be grateful if you would be kind enough to have a look at it - the edited bits are in BLUE.
