  • Anyone heard from abbey???

    Morning all,
    Was just wondering if anyone had heard anything from abbey if their case is currently stayed in the courts?????
    Mine was stayed ( along with many others) in July 2007. I have since had a payout of £800 under fh in august 2009. ( Original claim £4979 plus interest!!!).
    I notice Tuttsi had a letter in Jan but I have heard nothing? Should I contact court? contact Abbey?? or just sit tight???
    Any advice or comments???

    I have 3 stayed claims with Abbey and have heard nothing from them or my local court. No news is good news in my book!!!

    At the moment everything is still up in the air, so i'm very pleased my claim is just sitting in the system, so, until things are clearer, i'm not rocking the boat!!

    If the court decide to starting taking action in respect of the stayed claim then i'll act, but until then i'll just sit and wait until the powers at LB tell me what to do and how to do!!!!!

      yep, sit tight is the best plan, if you are concerned about your stay period coming to an end give the court a call and check with them. I think al claims not dealt with by banks/claimants will end up at directions hearings at the end of this year (but yes we should know what we're doing by then!)

        Following a blanket templated letter from Abbey dated December09 which was received by me on 4th January 2010 and on Ame's advice I did phone the court and they have not received anything from Abbey (thank god), but the court clerk did point out that it is my claim and they won't aactivate it unless I do, so that was very reassuring.

        For peace of mind call your County Court as it appears that the stays had different directions and check your own claims directly with the court. I found both Barnet CC and Central London Court very helpfull.

        Ame and the team are still working very hard behind the scenes to work on all the arguments and these matters should not be rushed. In the mean time if you can dig out your T&c's from inception of your account opening and any letters where Abbey talk about why they are charging you, this information will most definately help the team as we will if we want to carry on the claim, we will have to change our POC's and our arguments in line with the SC Judgement.

        Any help we can give the team will eventually help us.

          Thanks Tuttsi,
          I will see if I can find any T&C's from when I opened the account ( was a long time ago). My husband does say i am a bit of a horder so i will go through my paperwork and see if I can find anyhting that can help.

            Hello

            I too sent several letters to Abbey for a refund; but it didnt get to court stage.
            and I have recieved letter last week from Abbey stating the recent win with the banks etc, and how they wont be refunding my monies etc etc.
            I have since been charged around £140 in charges for unpaid direct debits; due to being about a £1 short;a nd they are still charging £35, £25 and £15 for their charges. When some banks have reduced to £5! This sint right surely?

            Am I in any position to write to ask for these recent charges paid back?

              You have to 28th February to deal with the reply to Abbey.

              As I said in my earlier post the team on Legal Beagles are working on this matter and in the mean time if you can have a rummage through your Abbey file for any letters or T&C's and post them up here omitting any personal details so that the team can work through the arguments in accordance with the SC judgement and a response that will be able to be used. I am told they are hoping to have this ready by mid-february as there is absolutely no point in writing now untill we have a way forward and everything become clearer. Please keep an eye on this thread for further developments.
