        mmmm lovely defence and counterclaim there

        wondering if you want to ask for a stay on the claim pending the test case outcome ? or just see if natwest ask ?

        Think thats the only directions you need, anything else at this stage (like disclosure of costs etc) would be quite pointless.

            Yes I think you should include directions asking for a stay pending resolution of test case, not just trust the bank to do it.

                Have you progressed your hardship claim yet?
                Could further weaken their resolve if they can see you have a clear hardship case as well.
                "Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin.                     Main thing is to get the claim in and underway - there isnt really a template - if you look in the hardship forum there are a number of examples of letters which you can adapt to your own circumstances, if you pop it up here (if you want to) then we can help you with it.

                        Irwins did not file an allocation questionaire - so as of the 23rd Nov - the court has thrown the case out. However in light of the Supreme Court hearing - i sure they will continue. So what are we to do now???

                            I had a General Form of Judgement or Order dated 9th Nov from the court stating
                            "Unless the Claimant files at Court the Allocation Questionnaire by 23/11/09 their claim will be struck out."

                            I phoned the court on 25th Nov and they told me that the case has been struck out as a result of the order dated 9th Nov. I am awaiting the court letter confirming this.

                              Thanks dev. Yes it is possible they will apply to vary this order then as they have 7 days from the date of the order.

                              We will have to wait and see.
