  • More charges!!!

    Hi guys

Just had a quick look at my online banking account with HSBC and it is showing £100 charges to be deducted on 13th September. I sent them a bank charges letter last week via recorded delivery (thanks again Ame x) so I know they have definitely received it. In the letter I proposed to pay them £10 a month until the test case is resolved and asked them to put the rest of my 'charges' on hold. My overdraft is now £603 and climbing!

I have changed over to another bank so my slalary is no longer going into HSBC account.

Should I sit and wait until I hear from them or write again?

    Cheers x

    Hi Mrs Skint,

You have done the right thing by setting up a parachute account, next thing to do is to write to HSBC again, with a statement of income and outgoings (a simple list is enough). Instruct them to freeze the account until the outcome of the OFT test case is resolved as their unlawful charges are causing you hardship.

    Best wishes,
    HOD...Liam..

      Re: More charges!!!

Leave them to charge themselves. So long as your charges cover your entire overdraft and you have no DD/SO/bill payments or regular card payments going out, it will just sit there growing till they pay themselves back. You are paying £10 a month in. Yes it will be going into a blackhole, but should anything kick off with them you can show you have been making payments as agreed and when it comes to refunding you those £10 will be knocked off.

The letter you sent was absolutely right (and basically the one Happy has just suggested you send) so just hang on for a response.

        Thanks Happyolddog

Only problem with the IE is that I don't have a deficit, but I still don't want to pay over £600 to HSBC when they have already charged me over £2,000.

If you don't have a deficit, just send them another letter, state you want the account frozen until the test case is resolved.

Guys please help - can't believe this has just happened. My work's accountant has only sent my wages to effing HSBC - now they've swallowed it up in charges! Not only that but some of my dd's now won't get paid at my new bank therefore incurring even more charges! What can I do. No money for food this month and gotta buy school uniforms.
Please please advise. thank you x

                Stupid question time

Did you inform them of the change of account details in Writing ? and how long ago did you do it ?

I'm thinking that if you did give it in writing and gave sufficient time for them to change the details then you 'could' sit down with your boss and ask nicely or then demand that they give you your wages again as you cannot afford to live without them and effectively its their fault, isn't it.

                  Hiya

Yes, I sent an email and sat down with her to explain why I wanted my details changed. Gonna pop up to work now and get the email and see her or the boss. Thanks x

and if its only happened today, they could possibly get their bank to recall it from your bank.

Unfortunately still overdrawn with HSBC to the tune of £659.11. They have had 2 letters from me - thanks Ame! I have also set up a Standing Order and they are being paid £10 per month as a "goodwill gesture"until the test case is resolved.

Received this letter this morning - any ideas what I should do?

                          Dear Sir/Madam,

                          Your ref:

Thank you for your letter of **DATE**, the contents of which are noted.

I am disputing the total value of these debts with **BANK** due to unlawful and unreasonable charges. As such, therefore, I consider this account to be in dispute and no further action or payment shall be made until this matter is resolved.
As per OFT guidelines Section 2.8k "not ceasing collection activity whilst investigating a reasonably queried or disputed debt."

This process may take some time, due to the Office of Fair Trading's test case, but I will try to expedite this issue as a matter of urgency.

Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS.

After taking advice, I am of the opinion that your continued pursuit is in violation of the Administration of Justice Act 1970 section 40, Protection from harassment Act 1997 section 3 as well as breaching a number of the OFT Collection Guidelines.

I reserve the right to report your actions to any such regulatory authorities as I see fit.
You have 14 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint.

I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets.

I would appreciate your due diligence in this matter.

I look forward to hearing from you in writing.

                          Yours BLAH

                              Mrs Skint, Moochamoo,

as i have suspected all along i am not the only one being totally kicked by HSBC..........

please have a look at the civil proceedings i plan to take post-unfair charges decision.......

i'd like to suggest an alliance, and if we find more in the same situation as ourselves we take mass civil action against those thieving swines..........the squeakier the wheel, the more oil is required............

my post is headlined "Unfair Bank Charges = Professional Negligence" in the HSBC section under banks.......
