    Right, we're a bit more in the picture now. Did you get an exemption from court fees originally by any chance ?

    I think for now forget the court claim and go back to natwest for hardship. If you didnt pay then I'd be inclined to withdraw it and start over but wait till you have youroriginal court documents as I'd like to see the Particulars Of Claim you entered see if its worth amending.

    Yes you should ask for the 8% interest - we have spreadsheet on here which will work it out for you or if you have your list of charges with dates you can give them to me and I'll do it for you.

    If you can complete an Income and Expenditure sheet too - the CFS sheet would be best but its a bit longwinded, theres shorter version on this link Legal Beagles

    Was the account included in your bankruptcy and are the charges you are claiming those incurred since then ?

      Dear Amethyst,

      In answers to your first question for the courts fee. I have been exempt from paying the courts fee and had filled out the form initially.

      I calculated the interest charges on the Default Judgement form and not on my claim form. I think, that’s where I got lost.

      I did not claim any unfair bank charges when I ran into the trouble had filed the Bankruptcy. I am claim from RBS dated 1998-1998 on one account which was fully maintained by myself. I claim the unfair charges on the other account from 2002-2005 and again up until this time I fully maintained my account. These account have been now closed.

      The Nationwide building Society account was opened just before my bankruptcy and it s a basic account which is the only one at the moment I have.
      Thank you for sending me the link for Legal Beagles spread sheet. I have just opened it and have seen it. This is much better the one banks have sent to me!!

      If you think, I still have a leg to stand on my banks unfair charges claim on my own, I can withdraw the claim from the county courts and start filling out my own I/E sheet but than how it would work if I have had the courts case and the banks did not defend in 14 days. I still have chances of winning here easily. Advise please….

      I am trying to find the copy of the original courts document and upload them later on today.

        Leave the court claim in place as it is for now - they could pay up rather than go through the hassle of applying for a set aside - will simply mean you lose the additional interest if it wasnt in the claim. However I would expect them to ask to set it aside although they may look at your hardship case first and if they would be paying up anyway might let the CCJ go. Stranger things have happened.

        I'd keep going with the hardship claim direct to the bank (and include the 8% in the letters)

        As nationwide was not within the bankruptcy and charges incurred after then you are fine to reclaim from them, thats all i was checking on that part.
