I havent been on this site for a long while;
I am with the Abbey and just before this OFT case; I had received my letter saying that all claims were now on hold blah blah blah.... I had put my final letter in as they hadnt replied about my threat of court action; so it was time to put into the court.
I had previously had a pay out of £895 of my £11,000 plus claim; i sent a letter thanking them for this and said this would now be deducted from my claim, and I would still be claiming for my unfair bank charges etc.
In the meantime like prob hundreds of people; I have continually been charged bank charges totally over the top charges as we all know.
My salary goes into my account and what with charges; paying my mortgage and bills I am always behind again and BINGO I am charged again; it is a viscous circle I cannont get out of.
They have now sent me a letter saying they are redcing my overdraft by £400 and this takes effect from June 09. There is no way I am able to pay £400 just like this as I am living in my overdraft and have been for some considerable time; DUE to these flaming bank charges constantly putting me over my limit.
Can anyone please advise if I should start again with my claim from requesting my bank statements for the last year and adding it all together with the previous 6 years I have??
I also am thinking would I qualify for the hardship case as I have definitly had more than £500 of charges in any one year.
Your help would be very much appreciated; I feel like a total newbie now with this time lapse since the OFT case.
