    I havent been on this site for a long while;
    I am with the Abbey and just before this OFT case; I had received my letter saying that all claims were now on hold blah blah blah.... I had put my final letter in as they hadnt replied about my threat of court action; so it was time to put into the court.

    I had previously had a pay out of £895 of my £11,000 plus claim; i sent a letter thanking them for this and said this would now be deducted from my claim, and I would still be claiming for my unfair bank charges etc.

    In the meantime like prob hundreds of people; I have continually been charged bank charges totally over the top charges as we all know.

    My salary goes into my account and what with charges; paying my mortgage and bills I am always behind again and BINGO I am charged again; it is a viscous circle I cannont get out of.

    They have now sent me a letter saying they are redcing my overdraft by £400 and this takes effect from June 09. There is no way I am able to pay £400 just like this as I am living in my overdraft and have been for some considerable time; DUE to these flaming bank charges constantly putting me over my limit.

    Can anyone please advise if I should start again with my claim from requesting my bank statements for the last year and adding it all together with the previous 6 years I have??
    I also am thinking would I qualify for the hardship case as I have definitly had more than £500 of charges in any one year.

    Your help would be very much appreciated; I feel like a total newbie now with this time lapse since the OFT case.

    First, get another bank account set up and get your wages paid into that, then leave the Abbey account alone as it is subject to the charges claim.

    Have you not been keeping all your new statements since your initial claim?
    Have you filed at court yet for this claim?

    Re £500 of charges - That is only one part of the criteria and everyone looks at it different

    Have a read of this guide to hardship and then make a decision on whether you feel you qualify

      have you filled in the I&E sheet? Sorry I can't do a link cos I'm crap at them (someone will have to give me a crash course)

      What grounds apart from the £500 a year charges do you think you would qualify under hardship? Have a read of the hardship rules. If you have mortgage, council tax and utilities arrears then you would stand more chance under hardship.

      First thing to do is fill in the I&E sheet, and post up as much detail as you can on this thread about your circumstances. If you don't want to post in the open forum then email to one of the team.

      And could this be moved out of successes into hardship claims please, someone?

          hello Folks;
          Thanks so much for the prompt reply.
          Yes I have got all statments; I need to have agood look and get them listed.

          I didnt file it to court as when I received the letter; I thought it best to wait, guess like us all didnt think it would still be dragging on.

          I am not in any arrears with mortgage or council tax as I make sure that I pay all these on time; BUT have in the past fallen behind and been late with mortgage payments.

          The problem I have is that I have nothing left to live on and fall behing wiht credit card payments and my mobile bill sometimes. I am juggling with my salary constantly.

          I have a halifax basic account with a bank card to buy groceries or pay bills with; shall i have my wages put into there? Shall i call Abbey to discuss first? I am hoping that they will let me pay the £400 off slowly rather than taking it in one go.

          I will fill this I&E sheet and have a look at the guide for claiming hardship; somehow I dont think I will be entitled to it. Shame becuase I dont think this OFT will ever end lol

            Have you got charges on your credit cards? If so, you could start by reclaiming them now. Credit cards are not covered by the OFt case and are fairly straightforward to reclaim. Who are the credit cards with?

            If I were you I would have your salary paid into another account, then Abbey won't be able to nick it all in one go to pay your overdraft off. Once you have diverted your salary you can contact them to make arrangements to pay off the o/d in affordable instalments

              Sounds like a plan; I will amend my salary to be paid into my other account as soon as.
              My only credit card is with capital one and very hefty interest too; so yes I will do that. I will dig all my statements out and get cracking; how far back can you go? I have only had the card for about 2 years mind.

              Is it worth me starting again with Abbey by adding the last years charges onto charges I already have? Shall I then put it all into court and sit tight? I will look at the hardship case; BUT I honesly dont think I am entitled to be honest, as I dont have loads of debt besides being in the **** with my bank account each month and owing them bloody money!

              Wendy if I need some help wiht credit card claims; can you help me if I need it?

                Yes, I'll help, as will anyone else who can. Crap One are dead easy to get charges back from. You usually have to file at court but don't let that worry you. They will try to fob you off but don't worry about that, they always give in. There is a spreadsheet in the templates you can use to enter all the charges onto. Budgie has just had a successful claim with Compounded Interest, which is a bit more complicated. You can go that way or just go for 8% stat when you file at court, which I personally think is easier. But whichever way you decide we will help you out.

                Make a list of the charges then send a Preliminary Request. They will tell you to bog off. Send them an LBA, they will tell you to bog off again, or may offer you a pathetic amount. File at court. They will say they will defend, then hey presto, offer you the full amount. That's pretty much what usually happens anyway. Are all your charges £12, or not? It's been a couple of years since my crap One claims, but as far as I know nothing has changed, I'm sure someone will jump in and correct me if it has.
