This is prolly in the wrong thread, if do i do apologise. What it is, is this...

The NHS has banned smoking on all trust grounds, but i`m looking into the legalities of smoking in your car, which is your own personal property and as the trust do not accept responsibility for vehicles parked on the grounds.

Just wondering if anybody had any useful info or have had experience in this field?

Don't know about the legalities of it Solowka but I have done it many times in our hospital grounds which have been non-smoking area for long time. I agree with you that my car is my personal space and would argue the toss if anyone said anything. However if they are your employers that might make a difference. It's a bit like the guy who has made his pub into a foreign consulate so that people can smoke in it I suppose.

you cant smoke in a works vehicle but your own personal vehicle is okay- but dont lob your butts out the window.

On what basis have they banned it?

If its simply their policy then the best they can do is ask you to leave.

I dont believe there is any statute or case law precdent to allow them to ban smoking in this way from a lawful viewpoint.

          Re: Smoking

          Hi Solo
I worked on the BAS and Concorde site for a while and within the grounds if you wore their uniform you were not allowed to be seen smoking. Many peeps were not happy with this issue, but apparently it had brought a dismissal in the passed.

the car park was huge and within the grounds, no one ever mentioned trying to smoke in their cars.

Why not flip the seat back out of sight and have a smoke and a lie down at the same time
