    Hi all,
My son has received 2 letters today
1 from Lloyds informing him they have no further interest in his account and have assigned & sold his account to LC Asset 1 S.A.R.L
The second from the above company wanting the outstanding amount from him directly
I take it this is just a business making money and should he pay them
He informed Lloyds several months ago that he couldnt afford to balance the account

    Your esteemed thoughts please

Do you have an FCA authorisation or address on the letter from LC Asset ?

Anything to do with Everyday Finance ? https://www.everydayfinance.ie/ ?

What was the debt originally ? Credit card ? Loan ? Overdraft ?

      Morning Amethyst,
It was an overdraft, the address is a PO box in London although SARL would suggest a French company. I cant see anything to do with FCA

Have you got the address for LC Asset please. What have this company said re interest ?

Lloyds have sold the overdraft debt to LC Asset so we need to work out who they are and if they are authorised

Are the letters direct from LC Asset ? What are the instructions for payment ?
Anything from everyday finance ? Anything from link financial ?

A pic of the letters ( redact personal info) would be helpful to know how he should respond.

How much approx was the overdraft ?
Is the bank account it was attached to closed ?
When did Lloyds call in the overdraft ?
Was your son previously in an IVA ?
            and so on

            Eg

#Right firstly tell them the calls must stop, you are entitled to do this, the Court of Appeal was clear in Roberts v Bank of Scotland and the High Court in Harrison v Link held that such conduct could give rise to an unfair relationship.

If they continue to call you must make a note of each call, date, time, etc, and keep the note safe, it will be evidence for any legal action

No, its unlikely to be a scam, the claim form will need defending within the strict time scales otherwise you will end up with a CCJ being entered.
