Thanks for the responses so far - please keep them coming.

As to any form of national campaign, once the story is sent to the media, no doubt there will be a significant amount of media coverage. It affects not only consumers, but given the sums involved and the current state of the banking sector, it will have significant economic consequences, too.

However, before approaching the press, I want to identify a number of cases that can be grouped together so as to get the GLOs off the ground. Unless and until we have those GLOs, and any necessary Legal Aid funding, it's not really something I want to advertise widely just yet.

I will keep everyone updated of any progress.

      Tom

          Hi Tom

We met at Peterborough earlier this year at the LB get together.

We have a claim with Halifax, just received notification that they are defending. This is a 18 year claim, and only one of the charges is within the 6 year period. Halifax have alread confirmed that my hubby and I have been approved for hardship under the FSA waiver rules, but they were only prepared to refund the one charge.

This I believe should be an interesting case given all the circumstances.

          xx

Re: Proposed Group Litigation Orders : Poll and Discussion

This is what we have so far:

                CAG - 3 or 4

                PC - 12

                LB - 4

As I understand it the idea is to get at least 2 claimants (the minimum requirement for a GLO) per bank (I think it's 11 banks) so a total of 11 GLOs with at least 2 signatories each. So at this stage the initial take-up is critical. As Amethyst pointed out, although pre-Christmas is not the best time to attract claimants, I'm sure that once the waiver is extended again in the next few weeks it will prompt more people to sign up.

Thanks Tuttsi for for bumping it on CAG!

At the point the GLOs are established I'd expect the resultant publicity to generate a snowball effect and adding litigants names to the Group Register is a relatively simple process.

I believe 2 firms of solicitors are interested in taking the project on to coordinate, apply for legal aid and instruct counsel - It'll involve barristers and QCs.

I'm dead excited about this. As Tom said in his post, these claims will be made to the multi-track which means the cases would probably be heard in the Commercial Court (the same court as the test case) and would therefore be precedent setting.

Re: Proposed Group Litigation Orders : Poll and Discussion

Do you have to have a current claim to participate, as I was waiting for the judgement b4 taking this step?

If not I'm in (with reservations) and I don't qualify for aid.

You would need to have a case in the courts already and qualify for legal aid as the legal fees would be horrendous

I not only bumped it up on Toms thread, I put the link from Toms thread on all the different banks threads, until I got to Yorkshire bank, and then I was stopped as they must have thought I was a spammer (lol) I thought I was banned but no I was'nt just stopped from copying and pasting the same thing over and over again.

Also, Exc, can you please clarify if I am reading this correctly only those that are eligable for legal aid will be able to participate!

Re: Proposed Group Litigation Orders : Poll and Discussion

I am very happy to get involved in this as i have a case with Halifax that is yet unresolved even though i have received an interim payment this is not the full amount they owe me and does not include interest.
I also have a claim in with Lloyds tsb that has yet been unresolved and so any thing that speeds up my case and for the good of everyone who has a claim in with the banks I am happy to get involved with this.

I would also qualify for legal aid so that is a bonus.

I know you did Tuts - that's my gal!

I'm not absolutely certain but I think that eligibility for legal aid would be required but I'm sure Tom can confirm.
