    Hi Peeps

    I applied to get my charges back and went through the hardship route...I have given the banks my IE over the phone...a week later they called me saying that they will close my case because "I volunteered started uni" that I pay for my studies....they said if you where in hardship I shouldn’t be going 2 uni....

    I'm a youth worker...and by 2012 youth workers must have a degree at minimum...so by the time it hits 2012 I would have got a degree...my view is that by having a degree it will be a way out for me from hardship (as you know, if you have a degree, u get better pay)

    I started uni...which required me to reduce my hours and also I have maxed out my credit card to pay bills buy food etc...and a lot of my direct debits have been unpaid due to luck of money in my account...I always go above my overdraft facility and get charged for it every month (this month I'm getting charged £180!!!!!) this is like a on going deadly cycle...and apparently hsbc said I'm not in hardship...

    if I get my charges back...I'm jus going to use to pay of the arrears, cc, council tax arrears etc...I need the money cos this is messing up my marriage and I have a 14 month old baby...

    can you guys please help me...what do I do now...who do I contact...who is the FOS and is there a template letter I can use...please help

              Right I am suppoasedly the expert at funding when in uni so I need to ask you a few questions

              . Does your partner work?
              .Who is your local authority(education)?
              .Does your course pay a bursary(nurses etc get a bursary)
              . Did you give up any benefits to go to uni?
              . Do you pay rent?
              . Do you pay council tax?
              Do you get working tax credits?
              Have you heard about the ACCESS TO LEARNING FUND at your university?
              Are you paying any child care fees?

              If you dont want to answer those questions on here please PM me all the answers and I will make sure you are getting everythin you are entitled to.

                Right first of all thanks for your PM it cetainly made things a lot clearer for me as you hve already done a degree things are different regarding the help you can get BUT
                This is what i know off the top of my head before I actually talk to anyone.

                1. You should put in a claim for housing benefit and council tax benefit even if you only get a small amount it helps. You are automatically entitled to a 25% reduction but you need proof from your uni that you are a student you can usually get this in the form of a letter from student information services.
                2. You should tell tax credits that you are a student sometimes it makes a difference(it did for me)
                3. Please go to your student union they have independent financial advisors who can look at all your circumstances and tell you if you are entitled to ANYTHING and calculate how much there and then and they will also re-negotiate with the council regarding your arrears that you are paying off and believe me they carry a lot of weight.
                4. Go to your ACCESS to LEARNING FUND department as they CAN and DO help and priority is given to parents and students like yourself. It is money given to them by the government specifically for students who are facing financial difficulties and it does NOT need to be paid back. This can range from several hundreds pounds to several thousand pounds.
                5. And finally regarding the above tell them you may have to leave your course due to your financial situation and they will do all they can to help you financially as NO uni wants to lose students due to lack of funds.
                They can make emergency payments of up to £250 the same day and even if you have already had funds from them you can reapply if your financial circumstances have changed at the uni I attend the ACCESS to LEARNING FUND payments are made each year at the beginning of semester 1 and semester 2 and also another awarded payment for the summer period. It is my understanding that ALL uni's operate in this way so please make the enquiry tomorrow or the next time you are on campus.

                I shall make some enquiries at uni and if I can get any further info I shall promptly post it here for you.

                And last but not least........Fair play to you for going back to uni and trying to better your future for yourself and your family I know its not easy!!!

                  hey...thanks for the reply...now...do i write a letter to the banks again to tell them 2 reasses my case and also do i contact the FOS? becuase the waiver states a some points...that if you are in one of these situation, then i consider in financial dificulty..obviuoly the bank ignored the other points??? will the FOS do something about it?

                    I would write to the bank in the first instance and insist that they re-assess your claim as one of hardship.

                    There is no template letter for this as it needs to be written from a personal angle rather than just having the blanks filled in with your details, but if have a read of some of the other hardship threads you'll get loads of pointers.

                      My O/H is also having a problem with HSBC paying out on hardship, despite two other banks accepting our hardship position. He is intending to write to the Chief Exec Officer, my thread is in the hardship section. If you cannot locate it I will copy the link for you.

                      VIP, is a private area, you pay a small subscription and it allows you into more areas on the site including the chat box where you can actually talk with other members. If you follow the links for the VIP it will explain it all. Much more work behind the scenes goes on in VIP areas and discussions especially on the Test Case.
