    Hey there legal beagles,

    I literally just signed up after one too many unpleasant phonecalls from HSBC from non-english call centre advisors who just make the stress all too much more than it should be (i am a call cente advisor my self but when it comes to me being on the other end of the calls it's a completely different matter!!!)

    I got told about this site by a good friend after complaining about how much money hsbc constantly take from me. So i'm hoping you can help me and tell me if i can actually write to claim anything back.

    So ive been with hsbc with a normal bank account since about january 07 and took out a credit card with them in august 07.

    In April 08 i moved out on my own so had to put my overdraft up. Hsbc charge everytime you put your overdraft up. Being young i didn't want to put it up by much, so went over my overdraft the same month. Which meant another charge. So the next month i pay both charges, plus another charge to put the overdraft up again. This happened another time. But then also around here they messed up one of my payments to my credit card, but i managed to get this refunded and sorted out.

    A few months down the line i get hit with some unknown bills, its a week before payday, my credit card is at its limit due to buying stuff to furnish the house and downpayments etc. so i ring up to up my overdraft just by a hundred and get told i cant. so i have absoloutly no money, i have bills due, i need ot eat so what else could i do apart from use the card anyway. so got hit with about £75 of charges. so at this point i hate them due to constant useless call centre advisors, constant charges probably reaching upto like £300. So i move banks. Because of this i cancel all Direct debits. In the first month i make one of payments. One being to the credit card of £10. Previously i have always paid £100 a month but as i was just doing a one of payment whilst sorting everything out before setting up DDs/standing orders for the following month.

    I get a call from HSBC telling me my mc has gone into collections due to missing the monthly min payment. my payment is due on the 1st of each month. i put 10 in before the first of August. The call centre advisor said my min payment is due of £40-£50. I tried to argue how is that so when my min. payment as stated on the back of all printed statements is off £5. She did not listen to me (as ever!!!!!) and did not understand (AS EVER!!!!) so i hung up (as usual!!)

    Can anyone make any sense of what i just wrote and advise me if i can claim for any of these constant charges they have been hitting me with? or just share my anger at hsbc!!!!!

    Hi and welcome to the site.

    First of all with regards your credit card. The £5 minimum payment specified on the reverse of your statement is most likely the ''a minimum repayment of at least 2% or £5 whichever the greater'' rather than your individual monthly minimum payment of 2% which is usually stated bottom right on the front of the bill. What was your approx balance at the time ?

    Yes you can reclaim the charges - the overlimit fee on the cards and the insufficient funds transactions on the bank account.

    I'm not sure about the overdraft arrangement fee when you upped your OD. I don't think so as it is a service charge.

    Hope that helps a little - have a look in our library for the first letters - which will be the DPA SAR if you dont have your statemets, or the preliminary request for payment if you do have them. You can go back 6 years.

      Thank you for the quick reply! I'll go look in the library now..

      At the time i was actually at my limit which was £2000 so i guess thats down to my ignorance there then. And not fully being aware of the situation.

        Aye that would scan with the minimum payment being £40-£50 a month.

        Sending you to collections for one missed payment is a bit strong...what is the position with the account now?
